53	53	Section 1. Section 570.851, Florida Statutes, is created 28
54	54	to read: 29
55	55	570.851 Fresh From Florida Roadside Farm Stand Signage 30
56	56	Program.— 31
57	57	(1) As used in this section, the term "roadside farm 32
58	58	stand" means any facility located on a farm and used to market 33
59	59	farm products as those terms are defined in s. 823.14(3). 34
60	60	(2) The Fresh From Florida Roadside Farm Stand Signage 35
61	61	Program is established within the department to provide 36
62	62	directional signage for certified roadside farm stands. 37
63	63	(3)(a) To qualify as a certified roadside farm stand, a 38
64	64	stand must: 39
65	65	1. Offer farm products for sale that are produced on the 40
66	66	premises. 41
67	67	2. Be open for business at least 4 days a week, 10 months 42
68	68	of the year. 43
69	69	3. Have an actual growing area of at least 87,120 sq uare 44
70	70	feet. 45
71	71	4. Offer tours of the growing area located on the 46
72	72	premises. 47
73	73	5. Display permanent signage on the premises specifying 48
74	74	the times for the tours and hours of operation of the 49
75	75	agricultural facility. 50

88	88	(b) To participate in the program, the owner o r operator 51
89	89	of a qualified roadside farm stand must apply to the department 52
90	90	to register as a certified roadside farm stand and pay 53
91	91	application and registration fees. 54
92	92	(c) To maintain designation as a certified roadside farm 55
93	93	stand, a stand must annually mee t the requirements under 56
94	94	paragraphs (a) and (b). 57
95	95	(d) An agricultural facility that produces wine or other 58
96	96	agricultural products but does not have a growing area on the 59
97	97	property does not qualify for the program. 60
98	98	(e) The commissioner may officially recognize a certified 61
99	99	roadside farm stand as a state tourist attraction. 62
100	100	(4)(a) The department, in consultation with the Fresh From 63
101	101	Florida Roadside Farm Stand Advisory Council, shall develop 64
102	102	uniform directional signage bearing a uniform Fresh From Flori da 65
103	103	roadside farm stand logo and emblem. 66
104	104	(b) Upon request of a certified roadside farm stand, the 67
105	105	Department of Transportation shall place directional signage 68
106	106	bearing the uniform Fresh From Florida roadside farm stand logo 69
107	107	and emblem on the rights -of-way of interstate highways and 70
108	108	primary and secondary roads. The owner or operator of the 71
109	109	certified roadside farm stand must pay a fee for the signage 72
110	110	placement. 73
111	111	(5) The department shall adopt rules to implement this 74
112	112	section. The rules must include the follow ing fees: 75

130	130	from qualifying as an agri tourism activity as defined in s. 81

132	132	Section 2. Section 570.8511, Florida Statutes, is created 83

136	136	(1) The Fresh From Florida Roadside Farm Stand Advisory 87
137	137	Council, an advisory council as defined in s. 20.03(7), is 88
138	138	established within the department. The council shall consist of 89
139	139	12 members to be appointed by the commissioner. Initially, 6 90
140	140	members shall be appointed by the commissioner for a 1 -year term 91
141	141	and 6 members for a 2 -year term. Thereafter, members shall be 92
142	142	appointed for 2-year terms. 93
143	143	(2) The meetings, powers, duties, procedures, and 94
144	144	recordkeeping of the advisory council shall be pursuant to s. 95
145	145	570.232. 96
146	146	(3) The council may annually submit to the commissioner 97
147	147	recommendations relating to the Fresh From Florida Roadside Farm 98
148	148	Stand Signage Program. 99
149	149	Section 3. This act shall take effect July 1, 2022. 100
