5353 Section 1. Section 570.851, Florida Statutes, is created 28

5555 570.851 Fresh From Florida Roadside Farm Stand Signage 30
5656 Program.— 31
5757 (1) As used in this section, the term "roadside farm 32
5858 stand" means any facility located on a farm and used to market 33
5959 farm products as those terms are defined in s. 823.14(3). 34
6060 (2) The Fresh From Florida Roadside Farm Stand Signage 35
6161 Program is established within the department to provide 36
6262 directional signage for certified roadside farm stands. 37
6363 (3)(a) To qualify as a certified roadside farm stand, a 38
6464 stand must: 39
6565 1. Offer farm products for sale that are produced on the 40
6666 premises. 41
6767 2. Be open for business at least 4 days a week, 10 months 42
6868 of the year. 43
6969 3. Have an actual growing area of at least 87,120 sq uare 44
7070 feet. 45
7171 4. Offer tours of the growing area located on the 46
7272 premises. 47
7373 5. Display permanent signage on the premises specifying 48
7474 the times for the tours and hours of operation of the 49
7575 agricultural facility. 50

8888 (b) To participate in the program, the owner o r operator 51
8989 of a qualified roadside farm stand must apply to the department 52
9090 to register as a certified roadside farm stand and pay 53
9191 application and registration fees. 54
9292 (c) To maintain designation as a certified roadside farm 55
9393 stand, a stand must annually mee t the requirements under 56
9494 paragraphs (a) and (b). 57
9595 (d) An agricultural facility that produces wine or other 58
9696 agricultural products but does not have a growing area on the 59
9797 property does not qualify for the program. 60
9898 (e) The commissioner may officially recognize a certified 61
9999 roadside farm stand as a state tourist attraction. 62
100100 (4)(a) The department, in consultation with the Fresh From 63
101101 Florida Roadside Farm Stand Advisory Council, shall develop 64
102102 uniform directional signage bearing a uniform Fresh From Flori da 65
103103 roadside farm stand logo and emblem. 66
104104 (b) Upon request of a certified roadside farm stand, the 67
105105 Department of Transportation shall place directional signage 68
106106 bearing the uniform Fresh From Florida roadside farm stand logo 69
107107 and emblem on the rights -of-way of interstate highways and 70
108108 primary and secondary roads. The owner or operator of the 71
109109 certified roadside farm stand must pay a fee for the signage 72
110110 placement. 73
111111 (5) The department shall adopt rules to implement this 74
112112 section. The rules must include the follow ing fees: 75

136136 (1) The Fresh From Florida Roadside Farm Stand Advisory 87
137137 Council, an advisory council as defined in s. 20.03(7), is 88
138138 established within the department. The council shall consist of 89
139139 12 members to be appointed by the commissioner. Initially, 6 90
140140 members shall be appointed by the commissioner for a 1 -year term 91
141141 and 6 members for a 2 -year term. Thereafter, members shall be 92
142142 appointed for 2-year terms. 93
143143 (2) The meetings, powers, duties, procedures, and 94
144144 recordkeeping of the advisory council shall be pursuant to s. 95
145145 570.232. 96
146146 (3) The council may annually submit to the commissioner 97
147147 recommendations relating to the Fresh From Florida Roadside Farm 98
148148 Stand Signage Program. 99
149149 Section 3. This act shall take effect July 1, 2022. 100
