2323 Be It Enacted by the Legislature of the State of Florida: 10

2525 Section 1. Subsections (2), (3), and (4) of section 12
2626 180.191, Florida Statutes, are renumbered as subsections (3), 13
2727 (4), and (5), respectively, subsection (1) of that section is 14
2828 amended, and a new subsection (2) is added to that section to 15
2929 read: 16
3030 180.191 Limitation on rates charged consumer outside city 17
3131 limits.— 18
3232 (1) Any municipality within this the state operating a 19
3333 water or sewer utility outside of the boundaries of such 20
3434 municipality shall charge consumers outside the boundaries 21
3535 rates, fees, and charges determ ined in one of the following 22
3636 manners: 23
3737 (a) It may charge the same rates, fees, and charges as 24
3838 consumers inside the municipal boundaries. However, in addition 25

5151 thereto, the municipality may add a surcharge of not more than 26
5252 25 percent of such rates, fees, an d charges to consumers outside 27
5353 the boundaries, except as provided in subsection (2) . Fixing of 28
5454 such rates, fees, and charges in this manner does shall not 29
5555 require a public hearing except as may be provided for service 30
5656 to consumers inside the municipality. 31
5757 (b) It may charge rates, fees, and charges that are just 32
5858 and equitable and that which are based on the same factors used 33
5959 in fixing the rates, fees, and charges for consumers inside the 34
6060 municipal boundaries , except as provided in subsection (2) . In 35
6161 addition thereto, the municipality may add a surcharge not to 36
6262 exceed 25 percent of such rates, fees, and charges for said 37
6363 services to consumers outside the boundaries. However, the total 38
6464 of all such rates, fees, and charges for the services to 39
6565 consumers outside the boundaries may shall not be more than 50 40
6666 percent in excess of the total amount the municipality charges 41
6767 consumers served within the municipality for corresponding 42
6868 service. No Such rates, fees, and charges may not shall be fixed 43
6969 until after a public hea ring at which all of the users of the 44
7070 water or sewer systems; owners, tenants, or occupants of 45
7171 property served or to be served thereby; and all others 46

7474 such rates, fees, or charges may be made in the same manner as 49

8888 such change or revision is to be made substantially pro rata as 51
8989 to all classes of service, both inside and o utside the 52
9090 municipality, no hearing or notice shall be required. 53
9191 (2) Any municipality within this state that operates a 54
9292 water or sewer utility providing service to customers in another 55
9393 recipient municipality using infrastructure located in the 56
9494 recipient municipality shall charge consumers in the recipient 57
9595 municipality the same rates, fees, and charges as it does the 58
9696 consumers inside its own municipal boundaries. 59
9797 Section 2. This act shall take effect July 1, 2022. 60
