A bill to be entitled 1 
An act relating to a state nutrition assistance 2 
reimbursement program; creating s. 402.88, F.S.; 3 
requiring the Department of Children and Families to 4 
develop and implement a nutrition assistance 5 
reimbursement program to reimburse eligible community -6 
based nonprofit organizations and nonprofit religious 7 
organizations providing certain enrollment assistance 8 
services; requiring the department to determine 9 
eligibility criteria and application procedures for 10 
the program; authorizing community -based nonprofit 11 
organizations and nonprofit religious organizations to 12 
apply for reimbursement under the program if a certain 13 
condition is met; requiring the submission of an 14 
application on a form prescribed by the department for 15 
reimbursement under the program; requiring the 16 
department to establish a funding mechanism to support 17 
the authorization of reimbursements under the program; 18 
requiring the department to adopt rules; providing an 19 
effective date. 20

Be It Enacted by the Legislature of the State of Florida: 22 
 23 
 Section 1.  Section 402.88, Florida Statutes, is created to 24 
read: 25

 402.88  State nutrition assistance reimbursement program. — 26 
 (1)  The department shall develop and impl ement a state 27 
nutrition assistance reimbursement program for the purpose of 28 
reimbursing eligible community -based nonprofit organizations or 29 
nonprofit religious organizations operating under s. 501(c)(3) 30 
of the Internal Revenue Code for administrative costs directly 31 
incurred in providing enrollment assistance services for food 32 
assistance programs, such as the Supplemental Nutrition 33 
Assistance Program and the Special Supplemental Nutrition 34 
Program for Women, Infants, and Children. 35 
 (2)  The department shall d etermine eligibility criteria 36 
and application procedures for the program. A community -based 37 
nonprofit organization or nonprofit religious organization may 38 
apply for reimbursement under the program if it has been 39 
providing enrollment assistance services as described in 40 
subsection (1) for at least 2 years. A community -based nonprofit 41 
organization or nonprofit religious organization must submit to 42 
the department an application on a form prescribed by the 43 
department for reimbursement under the program. 44 
 (3)  The department shall establish a funding mechanism to 45 
support the authorization of reimbursements under the program. 46 
 (4)  The department shall adopt rules to implement this 47 
section. 48 
 Section 2.  This act shall take effect July 1, 2022. 49
