3030 Be It Enacted by the Legislature of the State of Florida: 17

3232 Section 1. Paragraph (c) of subsection (1) of section 19
3333 401.465, Florida Statutes, is redesignated as paragraph (d), 20
3434 subsections (3) and (4) are r enumbered as subsections (4) and 21
3535 (5), respectively, paragraphs (b), (d), (i), and (j) of 22
3636 subsection (2) of that section are amended, new paragraphs (c) 23
3737 and (e) are added to subsection (1) of that section, and a new 24
3838 subsection (3) is added to that section, to read: 25

5151 401.465 911 public safety telecommunicator certification. — 26
5252 (1) DEFINITIONS.—As used in this section, the term: 27
5353 (c) "Public safety agency" has the same meaning as in s. 28
5454 365.171(3)(d). 29
5555 (e) "Telecommunicator cardiopulmonary resuscitation 30
5656 training" means specific training, including continuous 31
5757 education, that is evidence based and contains nationally 32
5858 accepted guidelines for high -quality telecommunicator 33
5959 cardiopulmonary resuscitation with the recognition of out -of-34
6060 hospital cardiac arrest over th e telephone and the delivery of 35
6161 telephonic instructions for treating cardiac arrest and 36
6262 performing compression -only cardiopulmonary resuscitation. 37
6363 (2) PERSONNEL; STANDARDS AND CERTIFICATION. — 38
6464 (b) A public safety agency , as defined in s. 39
6565 365.171(3)(d), may employ a 911 public safety telecommunicator 40
6666 trainee for a period not to exceed 12 months if the trainee 41
6767 works under the direct supervision of a certified 911 public 42
6868 safety telecommunicator, as determined by rule of the 43
6969 department, and is enrolled in a public safety telecommunication 44
7070 training program. 45
7171 (d) The department shall determine whether the applicant 46
7272 meets the requirements specified in this section and in rules of 47
7373 the department and shall issue a certificate to any person who 48
7474 meets such requirements. Such requirements must include all of 49
7575 the following: 50

8888 1. Completion of an appropriate 911 public safety 51

9090 2. Certification under oath that the applicant is not 53
9191 addicted to alcohol or any controlled substance .; 54
9292 3. Certification under oath that the applicant is free 55
9393 from any physical or mental defect or disease that might impair 56
9494 the applicant's ability to perform his or her duties .; 57
9595 4. Submission of the application fee prescribed in 58
9696 subsection (4). (3); 59

9898 which indicates compliance with subparagraphs 1., 2., and 3. ; 61

100100 6. Effective October 1, 2012, passage of an examination 63
101101 approved by the department which measures the applicant's 64
102102 competency and proficiency in the subject material of the public 65
103103 safety telecommunication training program. 66
104104 (i) If a person was employed as a 911 public safety 67
105105 telecommunicator or a state -certified firefighter before April 68
106106 1, 2012, he or she must pass the examination approved by the 69
107107 department which measures the competency and proficiency in the 70
108108 subject material of the public safety telecommunication program , 71
109109 as defined in paragraph (1)(c) . Upon passage of the examination, 72
110110 the completion of the public safety telecommun ication training 73
111111 program is waived. 74

125125 safety telecommunicator is waived for a person employed as a 76
126126 sworn state-certified law enforcement officer, if provided the 77
127127 officer: 78
128128 a. Is selected by his or he r chief executive to perform as 79
129129 a 911 public safety telecommunicator; 80
130130 b. Performs as a 911 public safety telecommunicator on an 81
131131 occasional or limited basis; and 82
132132 c. Passes the department -approved examination that 83
133133 measures the competency and proficiency of an applicant in the 84
134134 subject material comprising the public safety telecommunication 85
135135 program. 86
136136 2. A sworn state-certified law enforcement officer who 87
137137 fails an examination taken under subparagraph 1. must take a 88
138138 department-approved public safety telecomm unication training 89
139139 program before prior to retaking the examination. 90
140140 3. The testing required under this paragraph is exempt 91
141141 from the examination fee required under subsection (4) (3). 92
142142 (3) TELECOMMUNICATOR CARDIOPULMONARY RESUSCITATION. — 93
143143 (a) In addition to the certification and recertification 94
144144 requirements in this section, 911 public safety 95
145145 telecommunicators who answer telephone calls and provide 96
146146 dispatch functions for emergency medical conditions must 97
147147 complete telecommunicator cardiopulmonary resuscit ation training 98
148148 every 2 years. 99

162162 or dispatches telephone calls for emergency medical conditions 101
163163 may enter into a reciprocal agreement with another public safety 102
164164 agency or agency that receives or dispa tches such telephone 103
165165 calls, a dedicated phone line, or a call center to provide 104
166166 telephonic assistance in administering cardiopulmonary 105
167167 resuscitation, if the applicable agency, dedicated phone line, 106
168168 or call center that will be accepting the telephone calls 107
169169 employs 911 public safety telecommunicators who have completed 108
170170 telecommunicator cardiopulmonary resuscitation training pursuant 109
171171 to paragraph (a). 110
172172 2. Any employee of a public safety agency or agency 111
173173 receiving or dispatching telephone calls for emergency m edical 112
174174 conditions who answers such telephone calls must directly 113
175175 provide telephonic assistance in administering cardiopulmonary 114
176176 resuscitation, when appropriate, or transfer such calls to the 115
177177 applicable agency, dedicated phone line, or call center with 116
178178 which the transferring agency has a reciprocal agreement as 117
179179 provided in subparagraph 1. 118
180180 Section 2. This act shall take effect July 1, 2022. 119
