HB 745 2022 CODING: Words stricken are deletions; words underlined are additions. hb0745-00 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to solar photovoltaic facility 2 development; providing a short title; directing the 3 Department of Environmental Protection, in 4 coordination with the Office of Energy within the 5 Department of Agriculture and Consumer Services, to 6 conduct a study of brownfield sites and closed 7 landfill sites to determine viable locations for 8 redevelopment as solar photovoltaic facilities; 9 providing study requirements ; directing the department 10 to submit a report to the Governor, Legislature, 11 Florida Public Service Commission, and regional 12 planning council chairs by a specified date; providing 13 an effective date. 14 15 Be It Enacted by the Legislature of the State of Flor ida: 16 17 Section 1. (1) This act may be cited as the "Brownfields 18 to Brightfields Act." 19 (2) The Florida Department of Environmental Protection, in 20 coordination with the Office of Energy within the Department of 21 Agriculture and Consumer Services, shall conduct a study of 22 brownfield sites as defined in s. 288.107(1)(b) and closed 23 landfill sites to determine viable sites for redevelopment as 24 solar photovoltaic facilities. 25 HB 745 2022 CODING: Words stricken are deletions; words underlined are additions. hb0745-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (3) The study must include, at a minimum: 26 (a) A list of brownfield sites and closed landfill sites 27 with potential for redevelopment as solar photovoltaic 28 facilities, divided into high, medium, and low potential. The 29 list must be based on: 30 1. Site characteristics including physical, legal, and 31 zoning barriers to redevelopment. 32 2. Proximity to existing energy generation and 33 transmission infrastructure. 34 3. Proximity to current and projected population centers. 35 4. Environmental justice considerations, including, but 36 not limited to, the interim final recommendations of the 37 National Environmental Justice Advisory Council dated May 13, 38 2021. 39 (b) An assessment of the potential and logistics for solar 40 energy generation from a diverse subset of high to medium 41 potential sites for redevelopment, including a cost -benefit 42 analysis. Potential sites must vary in lot size, geographic 43 proximity to current and projected population centers, and 44 geographic region. 45 (c) An analysis of the potential costs and benefits of 46 installing solar photovoltaic facilities to adjacent 47 communities. 48 (d) A list of recommended local and state policy changes 49 to facilitate the redevelopment of brownfield and landfill sites 50 HB 745 2022 CODING: Words stricken are deletions; words underlined are additions. hb0745-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S into solar photovoltaic facilities. 51 (4) The department shall submit a report on the findings 52 and recommendations of the study to the Governor, President of 53 the Senate, Speaker of the House of Representatives, Florida 54 Public Service Commission, and chairs of each Florida Regional 55 Planning Council by August 1, 2023. 56 Section 2. This act shall take effect July 1, 2022. 57
