61 | 61 | | improve the security of the state's energy resources and enhance 36 |

62 | 62 | | preparedness and resilience statewide for a natur al disaster or 37 |
---|
63 | 63 | | a declared state of emergency. 38 |
---|
64 | 64 | | (2) DEFINITIONS.—As used in this section, the term: 39 |
---|
65 | 65 | | (a) "Critical disaster resilience facility" means: 40 |
---|
66 | 66 | | 1. Emergency operations centers or other buildings owned 41 |
---|
67 | 67 | | by a state, county, or municipal government agency and 42 |
---|
68 | 68 | | designated by appropriate authorities as places of community 43 |
---|
69 | 69 | | refuge which may be made available to provide temporary shelter 44 |
---|
70 | 70 | | and housing to citizens during a natural disaster or a declared 45 |
---|
71 | 71 | | state of emergency; 46 |
---|
72 | 72 | | 2. Hospitals, assisted living faci lities, and other public 47 |
---|
73 | 73 | | health facilities that are necessary to provide health services 48 |
---|
74 | 74 | | following a natural disaster or a declared state of emergency; 49 |

---|
98 | 98 | | declared state of emergency; and 61 |
---|
99 | 99 | | 6. Buildings housing state, county, or municipal 62 |
---|
100 | 100 | | governmental agencies providing services related to disaster 63 |
---|
101 | 101 | | preparedness or response. 64 |
---|
102 | 102 | | (b) "Department" means the Department of Agriculture and 65 |
---|
103 | 103 | | Consumer Services. 66 |
---|
104 | 104 | | (c) "Eligible costs" means 30 percent of all direct 67 |
---|
105 | 105 | | capital and labor costs associated with the purchase and 68 |
---|
106 | 106 | | installation of an onsite solar energy storage system. 69 |
---|
107 | 107 | | (d) "Onsite solar energy storage system" means a solar 70 |
---|
108 | 108 | | photovoltaic generation device or system that is paired with an 71 |
---|
109 | 109 | | electricity storage device or system that: 72 |

110 | 110 | | 1. Is located on a critical disaster resilience facility's 73 |
---|
111 | 111 | | premises and used primarily to offset all or part of the 74 |

132 | 132 | | (3) GRANTS.—The department shall establish a program to 83 |

133 | 133 | | issue grants to offset costs for the purchase or lease and 84 |
---|
134 | 134 | | installation of onsite solar energy storage systems to serve 85 |
---|
135 | 135 | | critical disaster resilience facilities. 86 |
---|
136 | 136 | | (4) APPLICATION PROCESS. — 87 |
---|
137 | 137 | | (a) An applicant seeking a grant, including an owner or 88 |
---|
138 | 138 | | installer of the onsite solar energy storage system apply ing on 89 |
---|
139 | 139 | | behalf of a critical disaster resilience facility, must submit 90 |
---|
140 | 140 | | an application to the department by a specified date as 91 |
---|
141 | 141 | | determined by the department. The application must include a 92 |
---|
142 | 142 | | complete description of all eligible costs, proof of purchase or 93 |
---|
143 | 143 | | lease of the onsite solar energy storage system for which the 94 |
---|
144 | 144 | | applicant is seeking a grant, and any other information deemed 95 |
---|
145 | 145 | | necessary by the department. 96 |
---|
146 | 146 | | (b) The department shall determine the grant eligibility 97 |
---|
147 | 147 | | of each applicant pursuant to this section and department rule. 98 |
---|
148 | 148 | | To the extent that funds are available, the department shall 99 |
---|
149 | 149 | | issue grants to eligible applicants on a competitive basis, 100 |
---|

165 | 165 | | (5) ENERGY STORAGE AND RENEWABLE ENERGY RESOURCES STUDY. — 104 |

166 | 166 | | (a) The department shall conduct or contract with a third 105 |

167 | 167 | | party to conduct a study on the effectiveness of using solar 106 |
---|
168 | 168 | | energy storage technologies and other renewable energy 107 |
---|
169 | 169 | | generation and storage technologies. 108 |
---|
170 | 170 | | (b) The study must include an assessment of the 109 |
---|
171 | 171 | | effectiveness of solar energy storage technologies under the 110 |
---|
172 | 172 | | pilot program. The assessment must be based on factors that may 111 |
---|
173 | 173 | | include, but are not limited to, the public health and safety, 112 |
---|
174 | 174 | | disaster preparedness and resilience, capital investment, net 113 |
---|
175 | 175 | | customer savings, net utility savings or deferred investments, 114 |
---|
176 | 176 | | net job creation, and impact on utility service rates and 115 |
---|
177 | 177 | | service quality. 116 |
---|
178 | 178 | | (c) The study must include all of the following: 117 |
---|
179 | 179 | | 1. Identification of existing policies relating to the use 118 |
---|
180 | 180 | | of solar energy storage technologies and other renewable energy 119 |
---|
181 | 181 | | generation and storage technologies. 120 |
---|
182 | 182 | | 2. Recommendations for expanding t he pilot program as a 121 |
---|
183 | 183 | | statewide energy security and disaster resilience policy. 122 |
---|
184 | 184 | | 3. Recommendations for statewide utility and state and 123 |
---|
185 | 185 | | local planning and procurement policies that will provide net 124 |
---|

204 | 204 | | (6) RULES.—The department may adopt rules to administer 131 |

206 | 206 | | (7) PILOT PROGRAM EXPIRATION. —This section expires on 133 |
---|
207 | 207 | | January 1, 2025. 134 |
---|
208 | 208 | | Section 2. For the 2022-2023 fiscal year, the sum of $10 135 |
---|
209 | 209 | | million in nonrecurring funds is appropriated from the General 136 |
---|
210 | 210 | | Revenue Fund to the Department of Agriculture and Consumer 137 |
---|
211 | 211 | | Services for the purpose of funding the energy security and 138 |
---|
212 | 212 | | disaster resilience pilot program created by this act. The 139 |
---|
213 | 213 | | department may use up to $100,0 00 to administer the pilot 140 |
---|
214 | 214 | | program and may use up to $150,000 to conduct or contract with a 141 |
---|
215 | 215 | | third party to conduct the energy storage and renewable energy 142 |
---|
216 | 216 | | resources study. 143 |
---|
217 | 217 | | Section 3. This act shall take effect upon becoming a law. 144 |
---|
