143143 Section 1. Subsections (4), (5), and (8) of section 94

163163 governing body who objects to the funding reduction, may file an 102
164164 appeal by petition to the Administration Commission within 30 103
165165 days after the day the tentative budget is posted to the 104
166166 official website of the municipality under subsection (3). The 105
167167 petition must set forth the tentative budget proposed by the 106
168168 municipality, in the form and manner prescribed by the Executive 107
169169 Office of the Governor and approved by the Administration 108
170170 Commission, the operating budget of the municipal law 109
171171 enforcement agency as approved by the municipality for the 110
172172 previous year, and state the reasons or grounds for the appeal. 111
173173 The petition shall be filed with the Executive Office of the 112
174174 Governor and a copy served upon the governing body of the 113
175175 municipality or to the clerk of the circuit court of the county 114
176176 in which the municipality is located. 115
177177 (b) The governing body of the municipality has 5 working 116
178178 days after service of a copy of the petition to file a reply 117
179179 with the Executive Office of the Governor and shall serve a copy 118
180180 of such reply to the petitioner. 119
181181 (5) Upon receipt of the petition, the Execut ive Office of 120
182182 the Governor shall provide for a budget hearing at which the 121
183183 matters presented in the petition and the reply shall be 122
184184 considered. A report of the findings and recommendations of the 123
185185 Executive Office of the Governor thereon shall be promptly 124

200200 municipality or amend or modify the budget as to each separate 127
201201 item within the operating budget of the municipal law 128
202202 enforcement agency. The budget as approved, amended, or modified 129
203203 by the Administration Commission shall be final. 130
204204 (6)(8) If the governing body of a municipality amends the 131
205205 budget pursuant to paragraph (5)(c) paragraph (7)(c), the 132
206206 adopted amendment must be posted on the off icial website of the 133
207207 municipality within 5 days after adoption and must remain on the 134
208208 website for at least 2 years. If the municipality does not 135
209209 operate an official website, the municipality must, within a 136
210210 reasonable period of time as established by the co unty or 137
211211 counties in which the municipality is located, transmit the 138
212212 adopted amendment to the manager or administrator of such county 139
213213 or counties who shall post the adopted amendment on the county's 140

236236 liability shall not include punitive damages or interest for t he 151
237237 period before judgment. Neither the state nor its agencies or 152
238238 subdivisions shall be liable to pay a claim or a judgment by any 153
239239 one person which exceeds the sum of $200,000 or any claim or 154
240240 judgment, or portions thereof, which, when totaled with all 155
241241 other claims or judgments paid by the state or its agencies or 156
242242 subdivisions arising out of the same incident or occurrence, 157
243243 exceeds the sum of $300,000. However, a judgment or judgments 158
244244 may be claimed and rendered in excess of these amounts and may 159
245245 be settled and paid pursuant to this act up to $200,000 or 160
246246 $300,000, as the case may be; and that portion of the judgment 161
247247 that exceeds these amounts may be reported to the Legislature, 162
248248 but may be paid in part or in whole only by further act of the 163
249249 Legislature. Notwith standing the limited waiver of sovereign 164
250250 immunity provided herein, the state or an agency or subdivision 165
251251 thereof may agree, within the limits of insurance coverage 166
252252 provided, to settle a claim made or a judgment rendered against 167
253253 it without further action by the Legislature, but the state or 168
254254 agency or subdivision thereof shall not be deemed to have waived 169
255255 any defense of sovereign immunity or to have increased the 170
256256 limits of its liability as a result of its obtaining insurance 171
257257 coverage for tortious acts in exce ss of the $200,000 or $300,000 172
258258 waiver provided above. The limitations of liability set forth in 173
259259 this subsection shall apply to the state and its agencies and 174

274274 (b) A municipality has a duty to allow the municipal law 177
275275 enforcement agency to respond appropriately to protect persons 178
276276 and property during a riot or an unlawful assembly based on the 179
277277 availability of adequate equipment to its munici pal law 180
278278 enforcement officers and relevant state and federal laws. If the 181
279279 governing body of a municipality or a person authorized by the 182
280280 governing body of the municipality breaches that duty, the 183
281281 municipality is civilly liable for any damages, including 184
282282 damages arising from personal injury, wrongful death, or 185
283283 property damages proximately caused by the municipality's breach 186
284284 of duty. The sovereign immunity recovery limits in paragraph (a) 187
285285 do not apply to an action under this paragraph. 188

385385 is visible at all times that clearly identifies the employing 252
386386 agency and that clearly identifies the person as a licensed 253
387387 security officer, or a security officer employed by the board of 254
388388 trustees of a community college, while the offic er, firefighter, 255
389389 emergency medical care provider, railroad special officer, 256
390390 traffic accident investigation officer, traffic infraction 257
391391 enforcement officer, inspector, analyst, operator, law 258
392392 enforcement explorer, parking enforcement specialist, public 259
393393 transit employee or agent, or security officer is engaged in the 260
394394 lawful performance of his or her duties, the offense for which 261
395395 the person is charged shall be reclassified as follows: 262
396396 (a) In the case of assault, from a misdemeanor of the 263
397397 second degree to a mi sdemeanor of the first degree. 264
398398 (b) In the case of battery, from a misdemeanor of the 265
399399 first degree to a felony of the third degree. Notwithstanding 266
400400 any other provision of law, a person convicted of battery upon a 267
401401 law enforcement officer committed in furth erance of a riot or an 268
402402 aggravated riot prohibited under s. 870.01 shall be sentenced to 269
403403 a minimum term of imprisonment of 6 months. 270
404404 (c) In the case of aggravated assault, from a felony of 271
405405 the third degree to a felony of the second degree. 272
406406 Notwithstanding any other provision of law, any person convicted 273
407407 of aggravated assault upon a law enforcement officer shall be 274
408408 sentenced to a minimum term of imprisonment of 3 years. 275

435435 thereof, willfully and maliciously defaces, injures, or 290
436436 otherwise damages by any m eans a memorial or historic property, 291
437437 as defined in s. 806.135(1), and the value of the damage to the 292
438438 memorial or historic property is greater than $200, commits a 293
439439 felony of the third degree, punishable as provided in s. 294
440440 775.082, s. 775.083, or s. 775.084. A court shall order any 295
441441 person convicted of violating this subsection to pay 296
442442 restitution, which shall include the full cost of repair or 297
443443 replacement of such memorial or historic property. 298
444444 (8)(9) A minor whose driver license or driving privilege 299

459459 withholding by performing community service at the rate of 1 day 302
460460 for each hour of community service performed. In addition, if 303
461461 the court determines that due to a family hardship, the minor's 304
462462 driver license or driving privilege is necessary for employment 305
463463 or medical purposes of the minor or a member of the minor's 306
464464 family, the court shall order the minor to perform community 307
465465 service and reduce the period of revocation, suspension, or 308
466466 withholding at the rate of 1 day for each hour of community 309
467467 service performed. As used in this subsection, the term 310
468468 "community service" means cleaning graffiti from public 311
469469 property. 312

533533 in s. 775.082, s. 775.083, or s. 775.084. As used in this 352
534534 subsection, the term "conditions arising from the riot" means 353
535535 civil unrest, power outages, curfews, or a reduction in the 354
536536 presence of or response time for first responders or homeland 355
537537 security personnel and the term "conditions arising from the 356
538538 emergency" means civil unrest, power outages, curfews, voluntary 357
539539 or mandatory evacuations, or a reduction in the presence of or 358
540540 response time for first responders or homeland security 359
541541 personnel. A person arrested for committing a burglary during a 360
542542 riot or an aggravated riot or within a county that is subject to 361
543543 such a state of emergency may not be released until the person 362
544544 appears before a committing magistrate at a first appearance 363
545545 hearing. For purposes of sentencing under chapter 921, a felony 364
546546 offense that is reclassified under this subsection is ranked one 365
