216216 Section 1. This act may be cited as the "Toxic Mold 143
217217 Protections Act." 144
218218 Section 2. Section 83.252, Florida Statutes, is created to 145

237237 landlord knows that mold, both visible and invisible or hidden, 152
238238 is present that affects, as defined in s. 381.0073, the dwelling 153
239239 unit or the building and the mold either exc eeds the permissible 154
240240 exposure limits to molds adopted pursuant to s. 381.00732 or 155
241241 poses a health threat in accordance with the mold assessment 156
242242 standards adopted pursuant to s. 381.00733. The written 157
243243 disclosure must be provided to: 158
244244 (a) Prospective tenants as soon as practicable and before 159
245245 entering into a rental agreement. 160
246246 (b) Current tenants in affected dwelling units and 161
247247 buildings as soon as is reasonably practicable. 162
248248 (2)(a) A commercial and industrial real property landlord 163
249249 is exempt from providing w ritten disclosure to prospective 164
250250 tenants as required in subsection (1) if the presence of mold 165
251251 was remediated in accordance with the mold remediation 166
252252 guidelines adopted pursuant to s. 381.00735. 167
253253 (b) A commercial and industrial real property landlord is 168
254254 not required to conduct air or surface tests of dwelling units 169
255255 or buildings to determine whether the presence of mold exceeds 170
256256 the permissible exposure limits to molds adopted pursuant to s. 171

258258 (3) A tenant of a commercial and industrial real prope rty 173
259259 who knows or is informed that mold is present in the building, 174
260260 heating system, ventilating or air -conditioning system, or 175

273273 appurtenant structures, or that there is a condition of chronic 176
274274 water intrusion or flood, shall inform the landlord in writing 177
275275 of such knowledge within a reasonable period of time. The tenant 178
276276 shall make the property available to the landlord or his or her 179
277277 agents for appropriate assessment or remedial action as soon as 180
278278 is reasonably practicable if the landlord is responsible for 181
279279 maintenance of the property. This section does not affect any 182
280280 existing duties and obligations of tenants and landlords under 183
281281 this part. 184
282282 (4) Commercial and industrial real property landlords who 185
283283 know or have received notice that mold is present in the 186
284284 building, heating system, ventilating or air -conditioning 187
285285 system, or appurtenant structures, or that there is a condition 188
286286 of chronic water intrusion or flood, have an affirmative duty, 189
287287 within a reasonable period of time, to assess the presence of 190
288288 mold or condition likely to result in the presence of mold and 191
289289 conduct any necessary remediation. 192
290290 (5) The requirements of this section do not apply to 193
291291 properties where the tenant is contractually responsible for 194
292292 maintenance of the property, including any remediation. How ever, 195
293293 any tenant of a commercial and industrial real property who 196
294294 knows or is informed that mold is present in the building, 197
295295 heating system, ventilating or air -conditioning system, or 198
296296 appurtenant structures, or that there is a condition of chronic 199
297297 water intrusion or flood, and is responsible for maintenance of 200

314314 Section 3. Section 83.253, Florida Statutes, is created to 205

316316 83.253 Properties owned, leased, or operated by public 207
317317 entities; disclosure. — 208
318318 (1) A public entity that owns, leases, or operates a 209
319319 building shall provide written disclosure to all building 210
320320 occupants and prospective tenants when the public entity knows, 211
321321 or has reasonable cause to believe, that a condition of chronic 212
322322 water intrusion or flood exists, or that mold, both visible and 213
323323 invisible or hidden, is present that affects, as defined in s. 214
324324 381.0073, the building or dwelling unit and the mold either 215
325325 exceeds the permissible exposure limits to molds adopted 216
326326 pursuant to s. 381.00732 or poses a health threat in accordance 217
327327 with the mold assessment standards adopted pursuant to s. 218
328328 381.00733. The written disclosure shall be provided to: 219
329329 (a) Prospective tenants as soon as practicable and before 220
330330 entering into a rental agreement. 221
331331 (b) Current building occupants in affected dwelling units 222
332332 or buildings as soon as is reasonably practicable. 223
333333 (2) A public entity is exempt from providing written 224

349349 Section 4. Section 83. 501, Florida Statutes, is created to 228

351351 83.501 Residential properties; disclosure. — 230
352352 (1) Except as otherwise provided in this section, a 231
353353 residential landlord shall provide written disclosure to 232
354354 prospective and current tenants when the residential lan dlord 233
355355 knows, or has reasonable cause to believe, that mold, both 234
356356 visible and invisible or hidden, is present that affects, as 235
357357 defined in s. 381.0073, the dwelling unit or the building and 236
358358 the mold either exceeds the permissible exposure limits to molds 237
359359 adopted pursuant to s. 381.00732 or poses a health threat in 238
360360 accordance with the mold assessment standards adopted pursuant 239
361361 to s. 381.00733. The written disclosure must be provided to: 240
362362 (a) Prospective tenants before entering into a rental or 241
363363 lease agreement. 242
364364 (b) Current tenants in affected dwelling units and 243
365365 buildings as soon as is reasonably practicable. 244
366366 (2)(a) A residential landlord is exempt from providing 245
367367 written disclosure to prospective tenants as required in 246
368368 subsection (1) if the presence of mold was remediated in 247
369369 accordance with the mold remediation guidelines adopted pursuant 248
370370 to s. 381.00735. 249

385385 whether the presence of mold exceed s the permissible exposure 252
386386 limits to molds adopted pursuant to s. 381.00732. 253
387387 (3) Residential landlords shall provide written disclosure 254
388388 to prospective tenants of the potential health risks and the 255
389389 health impact that may result from exposure to mold by 256
390390 distributing educational materials and resources developed and 257
391391 disseminated by the Department of Health pursuant to s. 258
392392 381.00735. 259
393393 (4)(a) This section does not relieve a seller, transferor, 260
394394 lessor, agent, landlord, or tenant from any responsibility for 261
395395 compliance with other requirements under state law. 262
396396 (b) This section does not alter or modify any right, 263
397397 remedy, or defense otherwise available under state law. 264
398398 Section 5. Section 381.0073, Florida Statutes, is created 265
399399 to read: 266
400400 381.0073 Definitions. —For purposes of this section and ss. 267
401401 381.00731-381.00736, the term: 268
402402 (1) "Advisory council" means the Toxic Mold Protection 269
403403 Advisory Council created pursuant to s. 381.00731. 270
404404 (2) "Affect" means to cause a condition by the presence of 271
405405 mold in a dwelling un it, building, appurtenant structures, 272
406406 common wall, heating system, or ventilating or air -conditioning 273
407407 system that affects the indoor air quality of the dwelling unit 274

421421 (3) "Authoritative bodies" means any recognized national 276
422422 or international entities with expertise in public health, mold 277
423423 identification and remediation, or environmental health, 278
424424 including, but not limited to, other states, the United States 279
425425 Environmental Protection Agency, the World Health Organization, 280
426426 the American Conference of Governmental Industrial Hygienists, 281
427427 the Centers for Disease Control and Prevention, and the American 282
428428 Industrial Hygiene Association. 283
429429 (4) "Building code enforcement official" has the same 284
430430 meaning as in s. 468.603(3). 285
431431 (5) "Department" means the Departme nt of Health. 286
432432 (6) "Indoor environment" means the affected dwelling unit 287
433433 or affected commercial and industrial building. 288
434434 (7) "Industrial hygienist" has the same meaning as in s. 289
435435 501.937(3)(b). 290
436436 (8) "Mold" means any form of multicellular fungi that 291
437437 lives on plant or animal matter and in indoor environments, 292
438438 including, but not limited to, Cladosporium, Penicillium, 293
439439 Alternaria, Aspergillus, Fusarium, Trichoderma, Memnoniella, 294
440440 Mucor, and Stachybotrys Chartarum, and is often found in water -295
441441 damaged building materials. 296
442442 (9) "Person" means an individual, corporation, company, 297
443443 association, partnership, limited liability company, 298
444444 municipality, public utility, or other public body or 299
445445 institution. 300

462462 381.00731 Toxic Mold Protection Advisory Council. — 305
463463 (1) The Toxic Mold Protection Advisory Council, an 306
464464 advisory council as defined in s. 20.03(7), is created adjunct 307
465465 to the department for the purpose of making recommendations and 308
466466 advising and assisting the department in the development and 309
467467 adoption of permissible exposure limits to molds in indoor 310
468468 environments and other mold identification, assessment, and 311
469469 remediation standards and guidelines. 312
470470 (2) The advisory council shall consist of 17 members as 313
471471 follows: 314
472472 (a) Two members who are public health officers, appointed 315
473473 by the State Surgeon General. 316
474474 (b) One member who is an environmental hea lth 317
475475 professional, appointed by the State Surgeon General. 318
476476 (c) One member who has expertise on the adverse health 319
477477 effects from exposure to molds, appointed by the State Surgeon 320
478478 General. 321
479479 (d) One member who is a building code enforcement 322
480480 official, appointed by the Secretary of Business and 323
481481 Professional Regulation. 324

509509 association advocating for affected consumers, including, but 340
510510 not limited to, commercial and industrial tenants; residential 341
511511 tenants; homeowners; environmental groups; and attorneys, 342
512512 appointed by the President of the Senate. 343
513513 (k) Two members who represent an organization or 344
514514 association advocating for affected industries, including, but 345
515515 not limited to, commercial and industrial building proprietors, 346
516516 managers, and landlords; residential building proprietors, 347
517517 managers, and landlords; builders; realtors; suppliers of 348
518518 building materials; and suppliers of furnishings, appointed by 349
519519 the Speaker of the House of Representatives. 350

532532 (3)(a) The initial members of the advisory council must be 351
533533 appointed by September 1, 2022. Each me mber must be appointed to 352
534534 a 4-year term. However, in order to achieve staggered terms, 353
535535 eight of the initial members must be appointed to a 2 -year term 354
536536 and nine of the initial members must be appointed to a 4 -year 355
537537 term. 356
538538 (b) A vacancy on the advisory counc il shall be filled in 357
539539 the same manner as the original appointment. 358
540540 (c) The advisory council shall elect a chair from among 359
541541 its members. 360
542542 (d) Members of the advisory council shall serve without 361
543543 compensation and are not entitled to reimbursement for per d iem 362
544544 and travel expenses pursuant to s. 112.061. 363
545545 (4)(a) The advisory council shall convene its first 364
546546 meeting by October 1, 2022. Thereafter, the advisory council may 365
547547 meet upon the call of the chair or upon the request of a 366
548548 majority of its members. 367
549549 (b) Meetings may be conducted in person or by 368
550550 teleconference or other electronic means. 369
551551 (5) The advisory council shall make recommendations and 370
552552 advise and assist the department regarding the development and 371
553553 adoption of permissible exposure limits to molds in indoor 372
554554 environments and other mold identification, assessment, and 373
555555 remediation standards and guidelines pursuant to ss. 381.00732 -374

582582 health, with an adequ ate margin of safety, and avoid any 389
583583 significant risk to public health. 390

585585 technological and economic feasibility when it develops and 392
