23 | 23 | | Section 1. Section 901.001, Florida Statutes, is created 10 |

25 | 25 | | 901.001 Citizen's arrest. — 12 |
---|
26 | 26 | | (1) It is the intent of the Legislature to abrogate any 13 |
---|
27 | 27 | | common law remedy of citizen's arrest. A private person who is 14 |
---|
28 | 28 | | not a law enforcement officer, as defined in s. 943.10(1), may 15 |
---|
29 | 29 | | not arrest another person for a violation of the laws of the 16 |
---|
30 | 30 | | state. 17 |
---|
31 | 31 | | (2) This section does not apply to a person who is a law 18 |
---|
32 | 32 | | enforcement officer, as defined in s. 943.10(1), who is acting 19 |
---|
33 | 33 | | outside of his or her jurisdiction. Such an officer may arrest a 20 |
---|
34 | 34 | | person who commits a felony in his or her presence or arrest a 21 |
---|
35 | 35 | | person when a felony has been committed and when the arresting 22 |
---|
36 | 36 | | officer has probable cause to believe, and does believe, that 23 |
---|
37 | 37 | | the person arrested committed the felony. 24 |

38 | 38 | | Section 2. This act shall take effect July 1, 2022. 25 |
