2121 Be It Enacted by the Legislature of the State of Florida: 8

2323 Section 1. Section 901.001, Florida Statutes, is created 10
2424 to read: 11
2525 901.001 Citizen's arrest. — 12
2626 (1) It is the intent of the Legislature to abrogate any 13
2727 common law remedy of citizen's arrest. A private person who is 14
2828 not a law enforcement officer, as defined in s. 943.10(1), may 15
2929 not arrest another person for a violation of the laws of the 16
3030 state. 17
3131 (2) This section does not apply to a person who is a law 18
3232 enforcement officer, as defined in s. 943.10(1), who is acting 19
3333 outside of his or her jurisdiction. Such an officer may arrest a 20
3434 person who commits a felony in his or her presence or arrest a 21
3535 person when a felony has been committed and when the arresting 22
3636 officer has probable cause to believe, and does believe, that 23
3737 the person arrested committed the felony. 24
3838 Section 2. This act shall take effect July 1, 2022. 25
