This act may be cited as the "Florida Consumer 15 Medical Reporting Protection Act." 16 Section 2. Section 501.0081, Florida Statutes, is created 17 to read: 18 501.0081 Late or delinquent medical account reporting. — 19 (1) A consumer reporting agency as defined in 15 U.S.C. s. 20 1681a(f) doing business in this state: 21 (a) Shall provide the con sumer a 36-month grace period 22 before reporting a late or delinquent medical account. 23 (b) May not include a late or delinquent medical account 24 in a consumer's credit score calculation for 10 years after the 25 HB 1091 2022 CODING: Words stricken are deletions; words underlined are additions. hb1091-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S date the agency reports the late or delinquent m edical account. 26 (2) A consumer reporting agency is subject to a minimum 27 fine of $10,000 for each violation of subsection (1). 28 (3) The Department of Agriculture and Consumer Services 29 shall adopt rules to implement and enforce this section. 30 Section 3. This act shall take effect July 1, 2022. 31
