33- (1) DEFINITIONS.—As used in this section, the term: 20
34- (a) "Anesthesiologist" means an allopathic or osteopathic 21
35-physician who holds an act ive, unrestricted license; who has 22
36-successfully completed an anesthesiology training program 23
37-approved by the Accreditation Council on Graduate Medical 24
38-Education or its equivalent; and who is certified by the 25

24+privileges may not be denied such privileges if the 11

53-Certification in Anesthesiology affiliated with the American 28
54-Association of Physician Specialists. 29
55- (g) "Direct supervision" means the physical presence of a 30
56-supervising anesthesiologist on t he premises such that the 31
57-supervising anesthesiologist is immediately available as needed 32
58-onsite, personal supervision by an anesthesiologist who is 33
59-present in the office when the procedure is being performed in 34
60-that office, or is present in the surgical o r obstetrical suite 35
61-when the procedure is being performed in that surgical or 36
62-obstetrical suite and who is in all instances immediately 37
63-available to provide assistance and direction to the 38
64-anesthesiologist assistant while anesthesia services are being 39
65-performed. 40
66- (3) PERFORMANCE OF ANESTHESIOLOGIST ASSISTANTS. 41
67- (a) An anesthesiologist assistant may assist an 42
68-anesthesiologist in developing and implementing an anesthesia 43
69-care plan for a patient , may personally administer the 44
70-prescribed anesthetic under the direct supervision of an 45
71-anesthesiologist, and may perform tasks and services as 46
72-specified in a written protocol approved by the supervising 47
73-anesthesiologist which may include any of the following 48
74-functions. In providing assistance to an anesthesiologist, an 49
75-anesthesiologist assistant may perform duties established by 50
51+ (a) "Anesthesiologist" means an allopathic or osteopathic 26

97-implementation of medically accepted monitoring techniques. 60
98- 4. Establish basic and advanced airway interventions, 61
99-including intubation of the trachea and performing ventilatory 62
100-support. 63
101- 5. Administer intermittent vasoactive drugs and start and 64

100+anesthesiologist designated by the group, as applicable all 63

104+ 7. The conditions or procedures that require the personal 67
105+provision of care by an anesthesiologist. 68
106+ 8. The procedures to be followed in the event of an 69

109+The protocol must be on file with the board before the 72

134- (6) ANESTHESIOLOGIST ASSISTANT LICENSURE. 85
135- (a) Any person desiring to be licensed as an 86
136-anesthesiologist assistant must apply to the department. The 87
137-department shall issue a license to any person certified by the 88
138-board to: 89
139- 1. Be at least 18 years of age. 90
140- 2. Have satisfactorily passed a proficiency examination 91
141-with a score established by the National Commission on 92
142-Certification of Anesthesiologist Assistants. 93
143- 3. Be certified in advanced cardiac life support. 94
144- 4. Have completed the application form and remitted an 95
145-application fee, not to exceed $1, 000, as set by the boards. An 96
146-application must include: 97
147- a. A certificate of completion of an approved graduate 98
148-level program. 99
149- b. An acknowledgment A sworn statement of any prior felony 100
125+anesthesiologist assistant in accordance with this paragraph, 76
126+and the anesthesiologist assistant may only practice under the 77
127+direct supervision of an anesthesiologist who is identified in 78
128+the has signed the protocol. The protocol must be updated 79
129+biennially. 80
130+ (3) PERFORMANCE OF ANESTHESIOLOGIST ASSISTANTS. — 81
131+ (a) An anesthesiologist assistant may assist an 82
132+anesthesiologist in developing and implementing an anesthesia 83
133+care plan for a patient , may personally administer the 84
134+prescribed anesthetic under the direct supervision of an 85
135+anesthesiologist, and may perform tasks and services as 86
136+specified in a written protoc ol approved by the supervising 87

208+ (d) An anesthesiologist assistant must clearly convey to 135
209+the patient that he or she is an anesthesiologist assistant. 136
210+ (e)(d) An anesthesiologist assistant may perform 137
211+anesthesia tasks and services within the framework of a written 138
212+practice protocol developed between the supervising 139
213+anesthesiologist and the anesthesiologist assistant. 140
214+ (f)(e) An anesthesiologist assistant may not prescribe, 141
215+order, or compound any controlled substance, leg end drug, or 142
216+medical device, nor may an anesthesiologist assistant dispense 143
217+sample drugs to patients. Nothing in this paragraph prohibits an 144
218+anesthesiologist assistant from administering legend drugs or 145
219+controlled substances; intravenous drugs, fluids, or blood 146
220+products; or inhalation or other anesthetic agents to patients 147
221+which are ordered by the supervising anesthesiologist and 148
