38- Section 1. Subsections (4) and (5) of section 286.29, 25

32+ 286.29 Climate-friendly public business. β€”The Legislature 19
33+recognizes the importance of leadership by state government in 20
34+the area of energy efficienc y and in reducing the greenhouse gas 21
35+emissions of state government operations. The following shall 22
36+pertain to all state agencies when conducting public business: 23

52- 286.29 Climate-friendly public business. β€”The Legislature 27
53-recognizes the importance of leadership by state government in 28
54-the area of energy efficiency and in reducing the greenhouse gas 29
55-emissions of state government operations. The following shall 30
56-pertain to all state agencies when conducting public business: 31
57- (4) When procuring new vehicles, all state agencies, state 32
58-universities, community colleges, and local governments that 33
59-purchase vehicles under a state purchasing plan shall first 34
60-define the intended purpose for the vehicle and determine which 35
61-of the following use classes for which the vehicle is being 36
62-procured: 37
63- (a) State business travel, designated operator; 38
64- (b) State business travel, pool operators; 39
65- (c) Construction, agricultural, or maintenance work; 40
66- (d) Conveyance of passengers; 41
67- (e) Conveyance of building or maintenance materials and 42
68-supplies; 43
69- (f) Off-road vehicle, motorcycle, or all -terrain vehicle; 44
70- (g) Emergency response; or 45
71- (h) Other. 46

73-Vehicles described in paragraphs (a) through (h), when being 48
74-processed for purchase or leasing agreements, must be selected 49
75-based on the lowest lifetime ownership costs over 5 years as 50

68+for fuel, operations, and maintenance, for the greatest fuel 43
69+efficiency available for a given use class when fuel economy 44
70+data are available. Exceptions may be made for individual 45
71+vehicles in paragraph (g) when accompanied, during the 46
72+procurement process, by d ocumentation indicating that the 47
73+operator or operators will exclusively be emergency first 48
74+responders or have special documented need for exceptional 49
75+vehicle performance characteristics. Any request for an 50

88-determined by the Department of Management Services. The 51
89-department shall annually rank vehicles based on the lowest cost 52
90-of ownership over 5 years using available industry data and 53
91-publish the rankings on the department's website. Any vehicle 54
92-that is a sedan or a light truck and is purchased under a state 55
93-purchasing plan must be ranked in the top 5 of the department's 56
94-rankings unless an exception is approved by the secretary of the 57
95-department and the secretary states the reason for the 58
96-exception. Law enforcement vehicles are exempt from the top 5 59
97-ranking requirement for the greatest fuel efficiency available 60
98-for a given use class when fuel economy data are available. 61
99-Exceptions may be made for individual vehicles in paragraph (g) 62
100-when accompanied, during the procurement process, by 63
101-documentation indicating that the operator or operators will 64
102-exclusively be emergency first responders or have special 65
103-documented need for exceptional vehicle performance 66
104-characteristics. Any request for an exception must be approved 67
105-by the purchasing agency head and any exceptional performance 68
106-characteristics denoted as a part of the procurement process 69
107-prior to purchase. 70
108- (5) All state agencies shall use ethanol and biodiesel 71
109-blended fuels when available. State agencies administering 72
110-central fueling operations for state -owned vehicles shall 73
111-procure biofuels for fleet needs to the greatest extent 74
112-practicable. 75

125- Section 2. Before July 1, 2023, the Department of 76
