34 | 34 | | name appears on the label of the hemp extract or hemp extract 21 |

35 | 35 | | product must apply to the department for a registration 22 |
---|
36 | 36 | | certificate on a form prescribed by the department. By applying 23 |
---|
37 | 37 | | to register the hemp extract or hemp extract product, the 24 |
---|
38 | 38 | | applicant assumes full responsibility for the registration, 25 |

54 | 54 | | issuance and must be renewed annually on or before its 29 |

56 | 56 | | 1. A completed registration certificate application must 31 |

57 | 57 | | be accompanied by all of the following: 32 |

58 | 58 | | a. A sample of the hemp extract or hemp extract product 33 |
---|
59 | 59 | | and a copy of the proposed labeling as it will be manufactured 34 |
---|
60 | 60 | | or distributed. 35 |
---|
61 | 61 | | b. A certificate of analysis pursuant to paragraph (a) 36 |
---|
62 | 62 | | which is dated no more than 30 days before the date upon which 37 |
---|
63 | 63 | | the registration application is submitted. 38 |
---|
64 | 64 | | c. An application fee not to exceed $500 for each hemp 39 |
---|
65 | 65 | | extract or hemp extract product established by department rule. 40 |
---|
66 | 66 | | The application fee shall be deposited into the departmen t's 41 |
---|
67 | 67 | | General Inspection Trust Fund. 42 |
---|
68 | 68 | | 2. The department may analyze a sample of the hemp extract 43 |
---|
69 | 69 | | or hemp extract product and inspect the label to ensure that the 44 |
---|
70 | 70 | | extract or product: 45 |

71 | 71 | | a. Meets all proposed labeling claims. 46 |
---|
72 | 72 | | b. Meets all requirements under this subsection and 47 |
---|
73 | 73 | | department rules. 48 |

74 | 74 | | c. Contains an acceptable hemp THC level. 49 |

75 | 75 | | d. Is not adulterated or misbranded pursuant to chapter 50 |
---|

92 | 92 | | Section 2. This act shall take effect on the same date 55 |

93 | 93 | | that HB 679 or similar legislation takes effect , if such 56 |

94 | 94 | | legislation is adopted in the same legislative session or an 57 |

95 | 95 | | extension thereof and becomes a law. 58 |
