2323 Be It Enacted by the Legislature of the State of Florida: 10

2525 Section 1. Paragraph (b) of subsection (7) of section 12
2626 581.217, Florida Statutes, as created by HB 679, is amended to 13
2727 read: 14
2828 581.217 State hemp program. — 15
2929 (7) DISTRIBUTION OF HEMP EXTRACT AND HEMP EXTRACT 16
3030 PRODUCTS.— 17
3131 (b) Each hemp extract and hemp extra ct product 18
3232 manufactured or distributed in the state must be registered with 19
3333 the department before distribution. The person or entity whose 20
3434 name appears on the label of the hemp extract or hemp extract 21
3535 product must apply to the department for a registration 22
3636 certificate on a form prescribed by the department. By applying 23
3737 to register the hemp extract or hemp extract product, the 24
3838 applicant assumes full responsibility for the registration, 25

5151 quality, and quantity of the extract or product manufactured or 26
5252 distributed in the state. A hemp extract or hemp extract product 27
5353 registration certificate is valid for 1 year after the date of 28
5454 issuance and must be renewed annually on or before its 29
5555 expiration date. 30
5656 1. A completed registration certificate application must 31
5757 be accompanied by all of the following: 32
5858 a. A sample of the hemp extract or hemp extract product 33
5959 and a copy of the proposed labeling as it will be manufactured 34
6060 or distributed. 35
6161 b. A certificate of analysis pursuant to paragraph (a) 36
6262 which is dated no more than 30 days before the date upon which 37
6363 the registration application is submitted. 38
6464 c. An application fee not to exceed $500 for each hemp 39
6565 extract or hemp extract product established by department rule. 40
6666 The application fee shall be deposited into the departmen t's 41
6767 General Inspection Trust Fund. 42
6868 2. The department may analyze a sample of the hemp extract 43
6969 or hemp extract product and inspect the label to ensure that the 44
7070 extract or product: 45
7171 a. Meets all proposed labeling claims. 46
7272 b. Meets all requirements under this subsection and 47
7373 department rules. 48
7474 c. Contains an acceptable hemp THC level. 49

9292 Section 2. This act shall take effect on the same date 55
9393 that HB 679 or similar legislation takes effect , if such 56
9494 legislation is adopted in the same legislative session or an 57
9595 extension thereof and becomes a law. 58
