5454 Section 1. Paragraph (a) of subsection (6) of section 29
5555 409.8132, Florida Statutes, is amended to read: 30

5757 (6) ELIGIBILITY.— 32
5858 (a) A child who has att ained the age of 1 year but who is 33
5959 under the age of 5 years is eligible to enroll in the Medikids 34
6060 program component of the Florida Kidcare program, if the child 35
6161 is a member of a family that has a family income which exceeds 36
6262 the Medicaid applicable income l evel as specified in s. 409.903, 37

6464 federal poverty level. In determining the eligibility of such a 39
6565 child, an assets test is not required. A child who is eligible 40
6666 for Medikids may elect to enroll i n Florida Healthy Kids 41
6767 coverage or employer -sponsored group coverage. However, a child 42
6868 who is eligible for Medikids may participate in the Florida 43
6969 Healthy Kids program only if the child has a sibling 44

8989 (a) A child who has attained the age of 1 year but who is 52
9090 under the age of 5 years is eligible to enroll in the Medikids 53
9191 program component of the Florida Kidcare program, if the child 54

9393 the Medicaid applicable income level as specified in s. 409.903, 56

133133 (3) A Title XXI-funded child who is eligible for the 84
134134 Florida Kidcare program who is a child with special h ealth care 85
135135 needs, as determined through a medical or behavioral screening 86
136136 instrument, is eligible for health benefits coverage from and 87
137137 shall be assigned to and may opt out of the Children's Medical 88
138138 Services Network. 89
139139 (4) The following children are not el igible to receive 90
140140 Title XXI-funded premium assistance for health benefits coverage 91
141141 under the Florida Kidcare program, except under Medicaid if the 92
142142 child would have been eligible for Medicaid under s. 409.903 or 93
143143 s. 409.904 as of June 1, 1997: 94
144144 (a) A child who is covered under a family member's group 95
145145 health benefit plan or under other private or employer health 96
146146 insurance coverage, if the cost of the child's participation is 97
147147 not greater than 5 percent of the family's income. If a child is 98
148148 otherwise eligible f or a subsidy under the Florida Kidcare 99

173173 undocumented immigrant. 112
174174 (d) A child who is an inmate of a public institution or a 113
175175 patient in an institution for mental diseases. 114
176176 (e) A child who is otherwise eligible for premium 115
177177 assistance for the Florida Kidcare program and has had his or 116
178178 her coverage in an employer -sponsored or private health benefit 117
179179 plan voluntarily canceled in the last 60 days, except those 118
180180 children whose coverage was voluntarily canceled for good cause, 119
181181 including, but not limited to, the following circumstances: 120
182182 1. The cost of participation in an employ er-sponsored 121
183183 health benefit plan is greater than 5 percent of the family's 122

238238 (a) The family is n ot eligible for premium assistance 153
239239 payments and must pay the full cost of the premium, including 154
240240 any administrative costs. 155
241241 (b) The board of directors of the Florida Healthy Kids 156
242242 Corporation may offer a reduced benefit package to these 157
243243 children in order to limit program costs for such families. 158
244244 (7) Once a child is enrolled in the Florida Kidcare 159
245245 program, the child is eligible for coverage for 12 months 160
246246 without a redetermination or reverification of eligibility, if 161
247247 the family continues to pay the applicab le premium. Eligibility 162
248248 for program components funded through Title XXI of the Social 163
249249 Security Act terminates when a child attains the age of 19. A 164
250250 child who has not attained the age of 5 and who has been 165
251251 determined eligible for the Medicaid program is eli gible for 166
252252 coverage for 12 months without a redetermination or 167
253253 reverification of eligibility. 168
254254 (8) When determining or reviewing a child's eligibility 169
255255 under the Florida Kidcare program, the applicant shall be 170
256256 provided with reasonable notice of changes in e ligibility which 171
257257 may affect enrollment in one or more of the program components. 172
258258 If a transition from one program component to another is 173
259259 authorized, there shall be cooperation between the program 174
260260 components and the affected family which promotes continuit y of 175

273273 health care coverage. Any authorized transfers must be managed 176
274274 within the program's overall appropriated or authorized levels 177
275275 of funding. Each component of the program shall establish a 178
276276 reserve to ensure that transfers between components will be 179
277277 accomplished within current year appropriations. These reserves 180
278278 shall be reviewed by each convening of the Social Services 181
279279 Estimating Conference to determine the adequacy of such reserves 182
280280 to meet actual experience. 183
281281 (9) In determining the eligibility of a chil d, an assets 184
282282 test is not required. If eligibility for the Florida Kidcare 185
283283 program cannot be verified using reliable data sources in 186
284284 accordance with federal requirements, each applicant shall 187
285285 provide documentation during the application process and the 188
286286 redetermination process, including, but not limited to, the 189
287287 following: 190
288288 (a) Proof of family income, which must be verified 191
289289 electronically to determine financial eligibility for the 192
290290 Florida Kidcare program. Written documentation, which may 193
291291 include wages and ea rnings statements or pay stubs, W -2 forms, 194
292292 or a copy of the applicant's most recent federal income tax 195
293293 return, is required only if the electronic verification is not 196
294294 available or does not substantiate the applicant's income. 197
295295 (b) A statement from all appl icable, employed family 198
296296 members that: 199

317317 (c) To enroll in the Children's Medical Services Network, 208
318318 a completed application, including a clinical scree ning. 209
319319 (10) Subject to paragraph (4)(a), the Florida Kidcare 210
320320 program shall withhold benefits from an enrollee if the program 211
321321 obtains evidence that the enrollee is no longer eligible, 212
322322 submitted incorrect or fraudulent information in order to 213
323323 establish eligibility, or failed to provide verification of 214
324324 eligibility. The applicant or enrollee shall be notified that 215
325325 because of such evidence program benefits will be withheld 216
326326 unless the applicant or enrollee contacts a designated 217
327327 representative of the program by a specified date, which must be 218
328328 within 10 working days after the date of notice, to discuss and 219
329329 resolve the matter. The program shall make every effort to 220
330330 resolve the matter within a timeframe that will not cause 221
331331 benefits to be withheld from an eligible enr ollee. 222
332332 (11) The following individuals may be subject to 223
333333 prosecution in accordance with s. 414.39: 224

356356 Section 4. Effective July 1, 2023, section 409.814, 235

576576 establish eligibility, or failed to provide verification of 383
577577 eligibility. The applicant or enrollee shall be notified that 384
578578 because of such evidence program benefits will be withheld 385
579579 unless the applicant or enroll ee contacts a designated 386
580580 representative of the program by a specified date, which must be 387
581581 within 10 working days after the date of notice, to discuss and 388
582582 resolve the matter. The program shall make every effort to 389
583583 resolve the matter within a timeframe that will not cause 390
584584 benefits to be withheld from an eligible enrollee. 391
585585 (11) The following individuals may be subject to 392
586586 prosecution in accordance with s. 414.39: 393
587587 (a) An applicant obtaining or attempting to obtain 394
588588 benefits for a potential enrollee under the Florida Kidcare 395
589589 program when the applicant knows or should have known the 396
590590 potential enrollee does not qualify for the Florida Kidcare 397
