5151 Section 1. Section 1013.29, Florida Statutes, is created 26

5353 1013.29 Prevention of lead in drinking water in public 28
5454 schools.— 29
5555 (1) The Legislature finds that: 30
5656 (a) The adverse health effects of lead exposure in 31
5757 children and adults are well documented, and no safe blood lead 32
5858 level in children has been id entified; 33
5959 (b) Lead accumulates in the body and can be ingested from 34
6060 various sources, including water sources used for drinking, food 35
6161 preparation, or cooking; and 36
6262 (c) All sources of lead should be controlled or eliminated 37
6363 to prevent childhood lead poiso ning. 38
6464 (2) As used in this section, the term "drinking water 39
6565 source" means any water source used for drinking, food 40
6666 preparation, or cooking. 41
6767 (3) For each district school, each school district shall 42
6868 do all of the following: 43
6969 (a) Install a minimum of one water bottle filling station 44
7070 per 100 students which has a certified point -of-use filter 45
7171 installed to remove lead. A school district may satisfy this 46
7272 requirement by replacing existing drinking water fountains. 47
7373 (b) Identify and install a barcode on all dr inking water 48

8888 on each drinking water source by the start of the 2023 -2024 51
8989 school year and thereafter maintain the filters to ensure that 52
9090 lead concentration levels are below one part per billion. The 53
9191 filters must be replaced no less frequently than provided for in 54
9292 the manufacturer's instructions. Filters and any replacement 55
9393 filters must be certified as compliant with NSF/ANSI Standard 56
9494 53. Sufficient filtered water must be available to meet the 57
9595 drinking water needs of all students, faculty, and staff. 58
9696 2. For each school cafeteria drinking water source, 59
9797 install a filter that reduces lead in drinking water and, at a 60
9898 minimum, maintain each filter in a manner consistent with the 61
9999 manufacturer's recommendations. The filter or all of the 62
100100 filter's component parts must meet NSF/ANSI Standard 53 or 63
101101 NSF/ANSI Standard 61, as applicable. 64
102102 (d) Post a conspicuous sign near each school water source 65
103103 that is not a drinking water source. The sign must includ e 66
104104 wording and an image that clearly communicate that water from 67
105105 the source should not be used for human consumption or, if 68
106106 applicable, food preparation or cooking. 69
107107 (e) Publish on the school district's website a list of all 70
108108 drinking water sources at such schools. At a minimum, the list 71
109109 must include for each drinking water source all of the 72
110110 following: 73
111111 1. The date on which the current filter was installed. 74
112112 2. The date on which the current filter is scheduled to be 75

135135 (5) Each school district may use any portion of its 86
136136 allocation from the A merican Rescue Plan Act of 2021, Pub. L. 87
137137 No. 117-2, which may be used for school facility repairs and 88
138138 improvements to meet the requirements of this section. 89
139139 Section 2. This act shall take effect July 1, 2022. 90
