A bill to be entitled 1 
An act relating to criminal records; amending s. 2 
943.059, F.S.; providing that a court may grant the 3 
sealing of a criminal record based on the sealing of a 4 
criminal record sealed by the Department of Law 5 
Enforcement under certain circumstances; requiring the 6 
Department of Law Enforcement to issue a certificate 7 
of eligibility under certain circumstances; providing 8 
an effective date. 9

Be It Enacted by the L egislature of the State of Florida: 11 
 12 
 Section 1.  Paragraph (f) is added to subsection (1) of 13 
section 943.059, Florida Statutes, to read: 14 
 943.059  Court-ordered sealing of criminal history 15 
records.— 16 
 (1)  ELIGIBILITY.—A person is eligible to petition a court 17 
to seal a criminal history record when: 18 
 (f)  The criminal history record was automatically sealed 19 
pursuant to s. 943.0595 and the subject of the sealed record 20 
presents proof of the sealing by the department to the court. 21 
The court may grant the seal ing of a criminal history record 22 
that was sealed by the department pursuant to s. 943.0595 at any 23 
time and without limitation based on any prior sealing of a 24 
subject's criminal records. The department shall issue a 25

certificate of eligibility for sealing up on request to a person 26 
who is the subject of a criminal history record sealed by the 27 
department pursuant to s. 943.0595. 28 
 Section 2.  This act shall take effect July 1, 2022. 29
