19	19	services to use certified minority, woman -owned, or 6
20	20	veteran-owned business enterprises as subcontractors 7
21	21	or subvendors for at least a specified minimum 8
22	22	percentage of the contract value; requiring a vendor 9
23	23	to identify subcontractors or subvendors when bidding 10
24	24	for such a contract; requiring the vendor to report 11
25	25	certain information regarding subcontractors or 12
26	26	subvendors upon performance or completion of the 13
27	27	contract; requiring the Office of Supplier Diversity 14
28	28	to commission a disparity study to review and evaluate 15
29	29	the use of minority, women -owned, and veteran-owned 16
30	30	business enterprises within this state by a specified 17
31	31	date; requiring the study results to be presented to 18
32	32	the Legislature by a specified date; provid ing an 19
33	33	appropriation; providing an effective date. 20

37	37	Section 1. Subsection (9) of section 287.057, Florida 24
38	38	Statutes, is amended to read: 25

53	53	(9) An agency shall require that may reserve any contract 28
54	54	for competitive solicitation may be awarded only to only among 29
55	55	vendors who agree to use certified minority business 30
56	56	enterprises, woman-owned business enterprises, or veteran -owned 31
57	57	business enterprises as subcontractors or subvendors for at 32
58	58	least 30 percent of the value of the contract . The percentage of 33
59	59	funds, in terms of gross contract amount and revenues, which 34
60	60	must be expended with such the certified minority business 35
61	61	enterprise subcontractors and subvendors must shall be 36
62	62	determined by the agency before the contract is made available 37
63	63	for bidding such contracts may be reserved . In order to bid on a 38
64	64	contract so reserved, the vendor must shall identify in a sworn 39
65	65	statement those certified minority business enterprises , woman-40
66	66	owned business enterprises, or veteran -owned business 41
67	67	enterprises that which will be used utilized as subcontractors 42
68	68	or subvendors by sworn statement. At the time of performance or 43
69	69	project completion, the contractor sh all report by sworn 44
70	70	statement the payments and completion of work for all certified 45
71	71	minority business enterprises , woman-owned business enterprises, 46
72	72	or veteran-owned business enterprises used in the contract. 47
73	73	Section 2. In order to ensure that the requ irement 48
74	74	established under s. 287.057(9), Florida Statutes, for 49
75	75	contracting with minority, woman -owned, or veteran-owned 50

88	88	enterprises is met, the Office of Supplier Diversity shall 51
89	89	commission a disparity study to review and evaluate the 52
90	90	statistical data indi cating the availability of, and disparity 53
91	91	in the use of, minority, woman -owned, and veteran-owned business 54
92	92	enterprises within this state. The study results must be 55
93	93	presented to the Legislature no later than December 1, 2023. 56
94	94	Section 3. For the 2022-2023 fiscal year, the nonrecurring 57
95	95	sum of $500,000 is appropriated from the General Revenue Fund to 58
96	96	the Office of Supplier Diversity within the Department of 59
97	97	Management Services for the purpose of conducting the disparity 60
98	98	study required by this act. Funds rem aining unexpended or 61
99	99	unencumbered from this appropriation as of June 30, 2023, shall 62
100	100	revert to the General Revenue Fund. 63
101	101	Section 4. This act shall take effect July 1, 2022. 64
