65 | 65 | | (a) "Agricultural cooperative association" means an 40 |

66 | 66 | | association established to promote, foster, and encourage the 41 |
---|
67 | 67 | | marketing of agricultural pro ducts through cooperation of 42 |
---|
68 | 68 | | agricultural producers. 43 |

69 | 69 | | (b) "Nonprofit membership organization" means a 44 |
---|
70 | 70 | | professional or trade association or any entity with dues paying 45 |
---|
71 | 71 | | members which is exempt from federal income tax under s. 46 |
---|
72 | 72 | | 501(c)(3) of the Internal Reven ue Code and which exists to serve 47 |
---|
73 | 73 | | its members beyond just offering health coverage. 48 |
---|
74 | 74 | | (4) A nonprofit membership organization or an agricultural 49 |

75 | 75 | | cooperative association may offer health care benefit coverage 50 |

89 | 89 | | considered insurance, notwithstanding any provision of law to 52 |
---|
90 | 90 | | the contrary. A nonprofit membership organization or an 53 |
---|
91 | 91 | | agricultural cooperative association offering health care 54 |
---|
92 | 92 | | benefit coverage to its members: 55 |
---|
93 | 93 | | (a) May, by a reinsurance agreement, cede any individual 56 |
---|
94 | 94 | | risk in whole or in part to an insurer having the power to make 57 |
---|
95 | 95 | | such reinsurance and authorized to do business in the state. 58 |
---|
96 | 96 | | (b) Shall, by February 28 of each year, file a signed, 59 |
---|
97 | 97 | | certified statement of actuarial opinion with the Com missioner 60 |
---|
98 | 98 | | of Insurance Regulation. 61 |
---|
99 | 99 | | (5) The commission may adopt rules to administer this 62 |
---|
100 | 100 | | section. 63 |
---|
101 | 101 | | Section 4. This act shall take effect January 1, 2023. 64 |
