2727 Be It Enacted by the Legislature of the State of Florida: 14

2929 Section 1. Subsection (24) of section 1001.42, Florida 16
3030 Statutes, is amended to read: 17
3131 1001.42 Powers and duties of district school board. β€”The 18
3232 district school board, acting as a board, shall exercise all 19
3333 powers and perform all duties listed below: 20
3434 (24) EMPLOYMENT CONTRACTS. β€” 21
3535 (a) If a school district enters into a contract or 22
3636 employment agreement, or renewal or renegotiation of an existing 23
3737 contract or employment agreement, with an officer, agent, 24
3838 employee, or contractor which contains a provision for severance 25

5353 (b) A district school board may not award an annual 28
5454 contract on the basis of any contingency or condition not 29
5555 expressly authorized in law by the Legislature or alter or limit 30
5656 its authority to award or not award an annual co ntract as 31
5757 provided in s. 1012.335. This paragraph applies only to a 32
5858 collective bargaining agreement entered into or renewed by a 33
5959 district school board on or after June 15, 2017. 34
6060 Section 2. Subsection (2) of section 1012.335, Florida 35
6161 Statutes, is amended to read: 36
6262 1012.335 Contracts with instructional personnel hired on 37
6363 or after July 1, 2011. β€” 38
6464 (2) EMPLOYMENT.β€” 39
6565 (a) Beginning July 1, 2011, Each individual newly hired as 40
6666 instructional personnel by the district school board shall be 41
6767 awarded a probationa ry contract. Upon successful completion of 42
6868 the probationary contract, the district school board may award 43
6969 an annual contract pursuant to paragraph (c). 44
7070 (b) Beginning July 1, 2011, An annual contract may be 45
7171 awarded pursuant to paragraph (c) for instructional personnel 46
7272 who have successfully completed a probationary contract with the 47
7373 district school board and have received one or more annual 48
7474 contracts from the district school board . 49
7575 (c) An annual contract may be awarded only if the 50

8989 1. Holds an active professional certificate or temporary 52
9090 certificate issued pursuant to s. 1012.56 and rules of the State 53

9292 2. Has been recommended by the district school 55
9393 superintendent for the annual contract based upon the 56
9494 individual's evaluation under s. 1012.34 and approved by the 57
9595 district school board. 58
9696 3. Has not received two consecutive annual performance 59
9797 evaluation ratings of unsatisfactory, two annual performance 60
9898 evaluation ratings of unsatisfactory within a 3 -year period, or 61
9999 three consecutive annual performance evaluation ratings of needs 62
100100 improvement or a combination of needs improvement and 63
101101 unsatisfactory under s. 1012.34. 64
102102 (d) Instructional personnel who receive an effective or 65
103103 highly effective rating at the conclusion of a contract year and 66
104104 are not the subject of any unresolved disciplinary action must 67
105105 have their contract renewed for the following school year unless 68
106106 the district school superintendent exercises hi s or her final 69
107107 authority to make a determination that the contract be 70
108108 nonrenewed, in which case the superintendent must provide in 71
109109 writing to the nonrenewed individual the reason for the 72
110110 nonrenewal. 73
111111 Section 3. This act shall take effect July 1, 2022. 74
