27 | 27 | | similar legislation enacted in the 2022 Regular Session or an 14 |

28 | 28 | | extension thereof and which becomes a law, is amended to read: 15 |

29 | 29 | | 943.0586 Cannabis expunction.— 16 |

30 | 30 | | (3) CERTIFICATE OF ELIGIBILITY. —Before petitioning a court 17 |

31 | 31 | | to expunge a criminal history record under this section, a 18 |

32 | 32 | | person seeking to expunge a criminal history record must apply 19 |
---|
33 | 33 | | to the department for a certificate of eligibility for 20 |
---|
34 | 34 | | expunction. The department shall adopt rules to establish 21 |
---|
35 | 35 | | procedures for applying for and issuing a certificate of 22 |
---|
36 | 36 | | eligibility for expunction. 23 |

37 | 37 | | (a) The department shall issue a certificate of 24 |

38 | 38 | | eligibility for expunction to a person who is the subject of a 25 |

61 | 61 | | placement in the Department of Law Enforcement Operating Trust 36 |

62 | 62 | | Fund, unless the executive director waives the fee . 37 |

63 | 63 | | Section 2. This act shall take effect on the same date 38 |
---|
64 | 64 | | that HB 1471 or similar legislation takes effect , if such 39 |
---|
65 | 65 | | legislation is adopted in the same legislative session or an 40 |
---|
66 | 66 | | extension thereof and becomes a law. 41 |
