2727 Be It Enacted by the Legislature of the State of Florida: 14

2929 Section 1. Subsection (8) is added to section 595.420, 16
3030 Florida Statutes, to read : 17
3131 595.420 Food recovery; legislative intent; department 18
3232 functions.— 19
3333 (8)(a) As used in this subsection: 20
3434 1. "Agricultural company" means a fruit or vegetable 21
3535 producer in the state that has an affiliated shipper and is 22
3636 licensed under the United States P erishable Agricultural 23
3737 Commodities Act. 24
3838 2. "Food recovery entity" means a nonprofit association 25

5151 engaged in food recovery and distribution with at least 20 years 26

5353 (b) Subject to appropriation, the department shall 28
5454 implement a pilot program to provide funds to food recovery 29
5555 entities to expand capabilities for extending the shelf life of 30
5656 fresh produce, including, but not limited to, labor, purchasing, 31
5757 packaging, storage, transportation, and distribution. 32
5858 (c) To qualify for fundi ng under this section, the food 33
5959 recovery entity must apply to the department and provide 34
6060 documentation that it receives fresh fruits and vegetables from 35
6161 an agricultural company, has food processing equipment and 36
6262 production capabilities, and operates a job training program. 37
6363 (d) The department shall submit a report on the pilot 38
6464 program, including recommendations for legislation, to the 39
6565 Governor, the President of the Senate, and the Speaker of the 40
6666 House of Representatives by January 1, 2025. 41
6767 (e) The department shall adopt rules to implement this 42
6868 subsection. 43
6969 Section 2. For the 2022-2023 fiscal year, the sum of $2 44
7070 million in nonrecurring funds is appropriated from the General 45
7171 Revenue Fund to the Department of Agriculture and Consumer 46
7272 Services to implement a pilot program pursuant to s. 595.420(8), 47
7373 Florida Statutes. 48
7474 Section 3. This act shall take effect July 1, 2022. 49
