An act relating to rent control measures; amending ss. 2 
125.0103, and 166.043, F.S.; removing provisions that 3 
require local government measures that impose rent 4 
controls to expire within a specified time period 5 
unless they are extended or renewed in accordance with 6 
law; conforming cross -references; providing an 7 
effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10 
 11 
 Section 1.  Subsectio ns (4) through (7) of section 12 
125.0103, Florida Statutes are renumbered as subsections (3) 13 
through (6), respectively, and present subsections (3) and (6) 14 
of that section are amended, to read: 15 
 125.0103  Ordinances and rules imposing price controls; 16 
findings required; procedures. — 17 
 (3)  Any law, ordinance, rule, or other measure which has 18 
the effect of imposing controls on rents shall terminate and 19 
expire within 1 year and shall not be extended or renewed except 20 
by the adoption of a new measure meeting all t he requirements of 21 
this section. 22 
 (5)(6) In any court action brought to challenge the 23 
validity of rent control imposed pursuant to the provisions of 24 
this section, the evidentiary effect of any findings or 25

recitations required by subsection (4)(5) shall be limited to 26 
imposing upon any party challenging the validity of such measure 27 
the burden of going forward with the evidence, and the burden of 28 
proof (that is, the risk of nonpersuasion) shall rest upon any 29 
party seeking to have the measure upheld. 30 
 Section 2.  Subsections (4) through (7) of section 166.043, 31 
Florida Statutes are renumbered as subsections (3) through (6), 32 
respectively, and present subsections (3) and (6) of that 33 
section are amended, to read: 34 
 166.043  Ordinances and rules imposing price cont rols; 35 
findings required; procedures. — 36

 Section 3.  This act shall take effect July 1, 2022. 50
