Paragraph (c) of subsection (1) of sect ion 11 893.13, Florida Statutes, is amended to read: 12 893.13 Prohibited acts; penalties. — 13 (1) 14 (c) Except as authorized by this chapter, a person may not 15 sell, manufacture, or deliver, or possess with intent to sell, 16 manufacture, or deliver, a controlled s ubstance in, on, or 17 within 1,000 feet of the real property comprising a child care 18 facility as defined in s. 402.302 or a public or private 19 elementary, middle, or secondary school between the hours of 6 20 a.m. and 12 midnight, or at any time in, on, or withi n 1,000 21 feet of real property comprising a state, county, or municipal 22 park, a community center, or a publicly owned recreational 23 facility. A person who violates this 27 paragraph with respect to: 28 1. A controlled substance named or described in s. 29 893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)5. 30 commits a felony of the first degree, punishable as provided in 31 s. 775.082, s. 775.083, or s. 775.084. The defendant must be 32 sentenced to a minimum term of imprisonment of 3 calendar years 33 unless the offense was committed within 1,000 feet of the real 34 property comprising a child care facility as defined in s. 35 402.302. 36 2. A controlled substance named or described in s. 37 893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)6., (2)(c)7., 38 (2)(c)8., (2)(c)9., (2)(c)10., (3), or (4) commits a felony of 39 the second degree, punishable as provided in s. 775.082, s. 40 775.083, or s. 775.084. 41 3. Any other controlled substance, except as lawfully 42 sold, manufactured, or delivered, must be sentenced to pay a 43 $500 fine and to serve 100 hours of public service in addition 44 to any other penalty prescribed by law. 45 46 This paragraph does not apply to a child care facility unless 47 the owner or operator of the facility posts a sign that is not 48 less than 2 square feet in size with a word legend identifying 49 the facility as a licensed chil d care facility and that is 50 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 3 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S posted on the property of the child care facility in a 51 conspicuous place where the sign is reasonably visible to the 52 public. 53 Section 2. Subsections (1) and (3) of section 893.135, 54 Florida Statutes, are amended to read: 55 893.135 Trafficking; mandatory sentences; suspension or 56 reduction of sentences; conspiracy to engage in trafficking. — 57 (1) Except as authorized in this chapter or in chapter 499 58 and notwithstanding the provisions of s. 893.13: 59 (a) Any person who knowingly sells, purchases, 60 manufactures, delivers, or brings into this state, or who is 61 knowingly in actual or constructive possession of, in excess of 62 25 pounds of cannabis, or 300 or more cannabis plants, commits a 63 felony of the first degree, which felony shall be known as 64 "trafficking in cannabis," punishable as provided in s. 775.082, 65 s. 775.083, or s. 775.084. If the quantity of cannabis involved: 66 1. Is in excess of 25 pounds, but less than 2,000 pounds, 67 or is 300 or more cannabi s plants, but not more than 2,000 68 cannabis plants, such person shall be sentenced to a mandatory 69 minimum term of imprisonment of 3 years, and the defendant shall 70 be ordered to pay a fine of $25,000. 71 2. Is 2,000 pounds or more, but less than 10,000 pounds , 72 or is 2,000 or more cannabis plants, but not more than 10,000 73 cannabis plants, such person shall be sentenced to a mandatory 74 minimum term of imprisonment of 7 years, and the defendant shall 75 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 4 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S be ordered to pay a fine of $50,000. 76 3. Is 10,000 pounds or mo re, or is 10,000 or more cannabis 77 plants, such person shall be sentenced to a mandatory minimum 78 term of imprisonment of 15 calendar years and pay a fine of 79 $200,000. 80 81 For the purpose of this paragraph, a plant, including, but not 82 limited to, a seedling or cutting, is a "cannabis plant" if it 83 has some readily observable evidence of root formation, such as 84 root hairs. To determine if a piece or part of a cannabis plant 85 severed from the cannabis plant is itself a cannabis plant, the 86 severed piece or part must have some readily observable evidence 87 of root formation, such as root hairs. Callous tissue is not 88 readily observable evidence of root formation. The viability and 89 sex of a plant and the fact that the plant may or may not be a 90 dead harvested plant are not relevant in determining if the 91 plant is a "cannabis plant" or in the charging of an offense 92 under this paragraph. Upon conviction, the court shall impose 93 the longest term of imprisonment provided for in this paragraph. 94 (b)1. Any person who knowingly sell s, purchases, 95 manufactures, delivers, or brings into this state, or who is 96 knowingly in actual or constructive possession of, 28 grams or 97 more of cocaine, as described in s. 893.03(2)(a)4., or of any 98 mixture containing cocaine, but less than 150 kilograms of 99 cocaine or any such mixture, commits a felony of the first 100 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 5 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S degree, which felony shall be known as "trafficking in cocaine," 101 punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 102 If the quantity involved: 103 a. Is 28 grams or more, but less tha n 200 grams, such 104 person shall be sentenced to a mandatory minimum term of 105 imprisonment of 3 years, and the defendant shall be ordered to 106 pay a fine of $50,000. 107 b. Is 200 grams or more, but less than 400 grams, such 108 person shall be sentenced to a mandato ry minimum term of 109 imprisonment of 7 years, and the defendant shall be ordered to 110 pay a fine of $100,000. 111 c. Is 400 grams or more, but less than 150 kilograms, such 112 person shall be sentenced to a mandatory minimum term of 113 imprisonment of 15 calendar year s and pay a fine of $250,000. 114 2. Any person who knowingly sells, purchases, 115 manufactures, delivers, or brings into this state, or who is 116 knowingly in actual or constructive possession of, 150 kilograms 117 or more of cocaine, as described in s. 893.03(2)(a)4 ., commits 118 the first degree felony of trafficking in cocaine. A person who 119 has been convicted of the first degree felony of trafficking in 120 cocaine under this subparagraph shall be punished by life 121 imprisonment and is ineligible for any form of discretionar y 122 early release except pardon or executive clemency or conditional 123 medical release under s. 947.149. The person intentionally killed an individual or 127 counseled, commanded, induced, procured, or caused the 128 intentional killing of an individual and such killing was the 129 result; or 130 b. The person's conduct in committing that act led to a 131 natural, though not inevitable, lethal result, 132 133 such person commits t he capital felony of trafficking in 134 cocaine, punishable as provided in ss. 775.082 and 921.142. Any 135 person sentenced for a capital felony under this paragraph shall 136 also be sentenced to pay the maximum fine provided under 137 subparagraph 1. 138 3. Any person who knowingly brings into this state 300 139 kilograms or more of cocaine, as described in s. 893.03(2)(a)4., 140 and who knows that the probable result of such importation would 141 be the death of any person, commits capital importation of 142 cocaine, a capital felony pu nishable as provided in ss. 775.082 143 and 921.142. Any person sentenced for a capital felony under 144 this paragraph shall also be sentenced to pay the maximum fine 145 provided under subparagraph 1. 146 (c)1. A person who knowingly sells, purchases, 147 manufactures, delivers, or brings into this state, or who is 148 knowingly in actual or constructive possession of, 4 grams or 149 more of any morphine, opium, hydromorphone, or any salt, 150 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 7 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S derivative, isomer, or salt of an isomer thereof, including 151 heroin, as described in s. 893.0 3(1)(b), (2)(a), (3)(c)3., or 152 (3)(c)4., or 4 grams or more of any mixture containing any such 153 substance, but less than 30 kilograms of such substance or 154 mixture, commits a felony of the first degree, which felony 155 shall be known as "trafficking in illegal d rugs," punishable as 156 provided in s. 775.082, s. 775.083, or s. 775.084. If the 157 quantity involved: 158 a. Is 4 grams or more, but less than 14 grams, such person 159 shall be sentenced to a mandatory minimum term of imprisonment 160 of 3 years and shall be ordered to pay a fine of $50,000. 161 b. Is 14 grams or more, but less than 28 grams, such 162 person shall be sentenced to a mandatory minimum term of 163 imprisonment of 15 years and shall be ordered to pay a fine of 164 $100,000. 165 c. Is 28 grams or more, but less than 30 kilo grams, such 166 person shall be sentenced to a mandatory minimum term of 167 imprisonment of 25 years and shall be ordered to pay a fine of 168 $500,000. 169 2. A person who knowingly sells, purchases, manufactures, 170 delivers, or brings into this state, or who is knowing ly in 171 actual or constructive possession of, 28 grams or more of 172 hydrocodone, as described in s. 893.03(2)(a)1.k., codeine, as 173 described in s. 893.03(2)(a)1.g., or any salt thereof, or 28 174 grams or more of any mixture containing any such substance, 175 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 8 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S commits a felony of the first degree, which felony shall be 176 known as "trafficking in hydrocodone," punishable as provided in 177 s. 775.082, s. 775.083, or s. 775.084. If the quantity involved: 178 a. Is 28 grams or more, but less than 50 grams, such 179 person shall be sent enced to a mandatory minimum term of 180 imprisonment of 3 years and shall be ordered to pay a fine of 181 $50,000. 182 b. Is 50 grams or more, but less than 100 grams, such 183 person shall be sentenced to a mandatory minimum term of 184 imprisonment of 7 years and shall b e ordered to pay a fine of 185 $100,000. 186 c. Is 100 grams or more, but less than 300 grams, such 187 person shall be sentenced to a mandatory minimum term of 188 imprisonment of 15 years and shall be ordered to pay a fine of 189 $500,000. 190 d. Is 300 grams or more, but l ess than 30 kilograms, such 191 person shall be sentenced to a mandatory minimum term of 192 imprisonment of 25 years and shall be ordered to pay a fine of 193 $750,000. 194 3. A person who knowingly sells, purchases, manufactures, 195 delivers, or brings into this state, o r who is knowingly in 196 actual or constructive possession of, 7 grams or more of 197 oxycodone, as described in s. 893.03(2)(a)1.q., or any salt 198 thereof, or 7 grams or more of any mixture containing any such 199 substance, commits a felony of the first degree, which felony 200 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 9 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S shall be known as "trafficking in oxycodone," punishable as 201 provided in s. 775.082, s. 775.083, or s. 775.084. If the 202 quantity involved: 203 a. Is 7 grams or more, but less than 14 grams, such person 204 shall be sentenced to a mandatory minimum term of imprisonment 205 of 3 years and shall be ordered to pay a fine of $50,000. 206 b. Is 14 grams or more, but less than 25 grams, such 207 person shall be sentenced to a mandatory minimum term of 208 imprisonment of 7 years and shall be ordered to pay a fine of 209 $100,000. 210 c. Is 25 grams or more, but less than 100 grams, such 211 person shall be sentenced to a mandatory minimum term of 212 imprisonment of 15 years and shall be ordered to pay a fine of 213 $500,000. 214 d. Is 100 grams or more, but less than 30 kilograms, such 215 person shall be sentenced to a mandatory minimum term of 216 imprisonment of 25 years and shall be ordered to pay a fine of 217 $750,000. 218 4.a. A person who knowingly sells, purchases, 219 manufactures, delivers, or brings into this state, or who is 220 knowingly in actual or c onstructive possession of, 4 grams or 221 more of: 222 a.(I) Alfentanil, as described in s. 893.03(2)(b)1.; 223 b.(II) Carfentanil, as described in s. 893.03(2)(b)6.; 224 c.(III) Fentanyl, as described in s. 893.03(2)(b)9.; 225 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 10 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S d.(IV) Sufentanil, as described in s. 89 3.03(2)(b)30.; 226 e.(V) A fentanyl derivative, as described in s. 227 893.03(1)(a)62.; 228 f.(VI) A controlled substance analog, as described in s. 229 893.0356, of any substance described in sub-subparagraphs a.-e. 230 sub-sub-subparagraphs (I)-(V); or 231 g.(VII) A mixture containing any substance described in 232 sub-subparagraphs a.-f. sub-sub-subparagraphs (I)-(VI), 233 234 commits a felony of the first degree, which felony shall be 235 known as "trafficking in fentanyl," punishable as provided in s. 236 775.082, s. 775.083, or s. 775.084. 237 b. If the quantity involved under sub -subparagraph a.: 238 (I) Is 4 grams or more, but less than 14 grams, such 239 person shall be sentenced to a mandatory minimum term of 240 imprisonment of 3 years, and shall be ordered to pay a fine of 241 $50,000. 242 (II) Is 14 grams or more, but less than 28 grams, such 243 person shall be sentenced to a mandatory minimum term of 244 imprisonment of 15 years, and shall be ordered to pay a fine of 245 $100,000. 246 (III) Is 28 grams or more, such person shall be sentenced 247 to a mandatory minimum term of imprisonment of 25 years, and 248 shall be ordered to pay a fine of $500,000. 249 5. A person who knowingly sells, purchases, manufactures, 250 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 11 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S delivers, or brings into this state, or who is knowingly in 251 actual or constructive possession of, 30 k ilograms or more of 252 any morphine, opium, oxycodone, hydrocodone, codeine, 253 hydromorphone, or any salt, derivative, isomer, or salt of an 254 isomer thereof, including heroin, as described in s. 255 893.03(1)(b), (2)(a), (3)(c)3., or (3)(c)4., or 30 kilograms or 256 more of any mixture containing any such substance, commits the 257 first degree felony of trafficking in illegal drugs. A person 258 who has been convicted of the first degree felony of trafficking 259 in illegal drugs under this subparagraph shall be punished by 260 life imprisonment and is ineligible for any form of 261 discretionary early release except pardon or executive clemency 262 or conditional medical release under s. 947.149. However, if the 263 court determines that, in addition to committing any act 264 specified in this paragra ph: 265 a. The person intentionally killed an individual or 266 counseled, commanded, induced, procured, or caused the 267 intentional killing of an individual and such killing was the 268 result; or 269 b. The person's conduct in committing that act led to a 270 natural, though not inevitable, lethal result, 271 272 such person commits the capital felony of trafficking in illegal 273 drugs, punishable as provided in ss. 775.082 and 921.142. A person who knowingly brings into this state 60 278 kilograms or more of any morphine, opium, oxycodone, 279 hydrocodone, codeine, hydromorphone, or any salt, derivative, 280 isomer, or salt of an isomer thereof, includ ing heroin, as 281 described in s. 893.03(1)(b), (2)(a), (3)(c)3., or (3)(c)4., or 282 60 kilograms or more of any mixture containing any such 283 substance, and who knows that the probable result of such 284 importation would be the death of a person, commits capital 285 importation of illegal drugs, a capital felony punishable as 286 provided in ss. 775.082 and 921.142. A person sentenced for a 287 capital felony under this paragraph shall also be sentenced to 288 pay the maximum fine provided under subparagraph 1. 289 (d)1. Any person wh o knowingly sells, purchases, 290 manufactures, delivers, or brings into this state, or who is 291 knowingly in actual or constructive possession of, 28 grams or 292 more of phencyclidine, as described in s. 893.03(2)(b)23., a 293 substituted phenylcyclohexylamine, as des cribed in s. 294 893.03(1)(c)195., or a substance described in s. 295 893.03(1)(c)13., 32., 38., 103., or 146., or of any mixture 296 containing phencyclidine, as described in s. 893.03(2)(b)23., a 297 substituted phenylcyclohexylamine, as described in s. 298 893.03(1)(c)195., or a substance described in s. 299 893.03(1)(c)13., 32., 38., 103., or 146., commits a felony of 300 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 13 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S the first degree, which felony shall be known as "trafficking in 301 phencyclidine," punishable as provided in s. 775.082, s. 302 775.083, or s. 775.084. If the quantity involved: 303 a. Is 28 grams or more, but less than 200 grams, such 304 person shall be sentenced to a mandatory minimum term of 305 imprisonment of 3 years, and the defendant shall be ordered to 306 pay a fine of $50,000. 307 b. Is 200 grams or more, but less than 400 g rams, such 308 person shall be sentenced to a mandatory minimum term of 309 imprisonment of 7 years, and the defendant shall be ordered to 310 pay a fine of $100,000. 311 c. Is 400 grams or more, such person shall be sentenced to 312 a mandatory minimum term of imprisonment of 15 calendar years 313 and pay a fine of $250,000. 314 2. Any person who knowingly brings into this state 800 315 grams or more of phencyclidine, as described in s. 316 893.03(2)(b)23., a substituted phenylcyclohexylamine, as 317 described in s. 893.03(1)(c)195., or a su bstance described in s. 318 893.03(1)(c)13., 32., 38., 103., or 146., or of any mixture 319 containing phencyclidine, as described in s. 893.03(2)(b)23., a 320 substituted phenylcyclohexylamine, as described in s. 321 893.03(1)(c)195., or a substance described in s. 322 893.03(1)(c)13., 32., 38., 103., or 146., and who knows that the 323 probable result of such importation would be the death of any 324 person commits capital importation of phencyclidine, a capital 325 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 14 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S felony punishable as provided in ss. 775.082 and 921.142. Any 326 person sentenced for a capital felony under this paragraph shall 327 also be sentenced to pay the maximum fine provided under 328 subparagraph 1. 329 (e)1. Any person who knowingly sells, purchases, 330 manufactures, delivers, or brings into this state, or who is 331 knowingly in actual or constructive possession of, 200 grams or 332 more of methaqualone or of any mixture containing methaqualone, 333 as described in s. 893.03(1)(d), commits a felony of the first 334 degree, which felony shall be known as "trafficking in 335 methaqualone," punishable as provided in s. 775.082, s. 775.083, 336 or s. 775.084. If the quantity involved: 337 a. Is 200 grams or more, but less than 5 kilograms, such 338 person shall be sentenced to a mandatory minimum term of 339 imprisonment of 3 years, and the defendant shall be ordered to 340 pay a fine of $50,000. 341 b. Is 5 kilograms or more, but less than 25 kilograms, 342 such person shall be sentenced to a mandatory minimum term of 343 imprisonment of 7 years, and the defendant shall be ordered to 344 pay a fine of $100,000. 345 c. Is 25 kilograms or more, such person shall be sentenced 346 to a mandatory minimum term of imprisonment of 15 calendar years 347 and pay a fine of $250,000. 348 2. Any person who knowingly brings into this state 50 349 kilograms or more of methaqualone or of any mixture containing 350 HB 6021 2022 CODING: Words stricken are deletions; words underlined are additions. hb6021-00 Page 15 of 74 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S methaqualone, as described in s. 893.03(1)(d), and who knows 351 that the probable result of such importation would be the death 352 of any person commits capital importation of methaqualone, a 353 capital felony punishable as provided in ss. 775.082 and 354 921.142. Any person sentenced for a capital felony under this 355 paragraph shall also be sentenced to pay the maximum fine 356 provided under subparagraph 1. 357 (f)1. Any person who knowingly sells, purchases, 358 manufactures, delivers, or brings into this state, or who is 359 knowingly in actual or constructive possession of, 14 grams or 360 more of amphetamine, as described in s. 893.03(2)(c)2., or 361 methamphetamine, as described in s. 893.03(2)(c)5., or of any 362 mixture containing amphetamine or methamphetamine, or 363 phenylacetone, phenylacetic ac id, pseudoephedrine, or ephedrine 364 in conjunction with other chemicals and equipment utilized in 365 the manufacture of amphetamine or methamphetamine, commits a 366 felony of the first degree, which felony shall be known as 367 "trafficking in amphetamine," punishable as provided in s. 368 775.082, s. 775.083, or s. 775.084. If the quantity involved: 369 a. Is 14 grams or more, but less than 28 grams, such 370 person shall be sentenced to a mandatory minimum term of 371 imprisonment of 3 years, and the defendant shall be ordered to 372 pay a fine of $50,000. 373 b. Is 200 grams or more, such p erson shall be sentenced to 378 a mandatory minimum term of imprisonment of 15 calendar years 379 and pay a fine of $250,000. 380 2. Any person who knowingly manufactures or brings into 381 this state 400 grams or more of amphetamine, as described in s. 382 893.03(2)(c)2., or methamphetamine, as described in s. 383 893.03(2)(c)5., or of any mixture containing amphetamine or 384 methamphetamine, or phenylacetone, phenylacetic acid, 385 pseudoephedrine, or ephedrine in conjunction with other 386 chemicals and equipment used in the manufacture of amphetamine 387 or methamphetamine, and who knows that the probable result of 388 such manufacture or importation would be the death of any person 389 commits capital manufacture or importation of amphetamine, a 390 capital felony punishable as provided in ss. 775.082 and 391 921.142. Any person sentenced for a capital felony under this 392 paragraph shall also be sentenced to pay the maximum fine 393 provided under subparagraph 1. 394 (g)1. Is 4 grams or more but less than 14 grams, such person 403 shall be sentenced to a mandatory minimum term of imprisonment 404 of 3 years, and the defendant shall be ordered to pay a fine of 405 $50,000. 406 b.
