2222 Be It Enacted by the Legislature of the State of Florida: 9

2424 Section 1. Subsection (4) of section 12 5.01055, Florida 11
2525 Statutes, is amended to read: 12
2626 125.01055 Affordable housing. — 13
2727 (4) In exchange for a developer fulfilling the 14
2828 requirements of subsection (2) or, for residential or mixed -use 15
2929 residential development, the requirements of subsection (3), a 16
3030 county must provide incentives to fully offset all costs to the 17
3131 developer of its affordable housing contribution or linkage fee. 18
3232 Such incentives may include, but are not limited to: 19
3333 (a) Allowing the developer density or intensity bonus 20
3434 incentives or more floor space than allowed under the current or 21
3535 proposed future land use designation or zoning; 22
3636 (b) Reducing or waiving fees, such as impact fees or water 23
3737 and sewer charges; or 24
3838 (c) Granting other incentives. 25

5151 Section 2. Subsection (4) of section 166. 04151, Florida 26
5252 Statutes, is amended to read: 27
5353 166.04151 Affordable housing. — 28
5454 (4) In exchange for a developer fulfilling the 29
5555 requirements of subsection (2) or, for residential or mixed -use 30
5656 residential development, the requirements of subsection (3), a 31
5757 municipality must provide incentives to fully offset all costs 32
5858 to the developer of its affordable housing contribution or 33
5959 linkage fee. Such incentives may include, but are not limited 34
