2323 Be It Enacted by the Legislature of the State of Florida: 10

2525 Section 1. Paragraph (b) of subsection (4) of section 12
2626 287.055, Florida Statutes, is amended to read: 13
2727 287.055 Acquisition of professional architectural, 14
2828 engineering, landscape architectural, or surveying and mapping 15
2929 services; definitions; procedures; contingent fees p rohibited; 16
3030 penalties.— 17
3131 (4) COMPETITIVE SELECTION. — 18
3232 (b) The agency shall select in order of preference no 19
3333 fewer than three firms deemed to be the most highly qualified to 20
3434 perform the required services. In determining whether a firm is 21
3535 qualified, the agency shall consider such factors as the ability 22
3636 of professional personnel; whether a firm is a certified 23
3737 minority business enterprise; past performance; willingness to 24
3838 meet time and budget requirements; location; recent, current, 25

5151 and projected workloads of the firms; and the volume of work 26
5252 previously awarded to each firm by the agency , with the object 27
5353 of effecting an equitable distribution of contracts among 28
5454 qualified firms, provided such distribution does not violate the 29
5555 principle of selection of the most h ighly qualified firms . The 30
5656 agency may request, accept, and consider proposals for the 31
5757 compensation to be paid under the contract only during 32
5858 competitive negotiations under subsection (5). 33
5959 Section 2. This act shall take effect July 1, 2022. 34
