21	21	Be It Enacted by the Legislature of the State of Florida: 8

23	23	Section 1. Section 893.145, Florida Statutes, is amended 10
24	24	to read: 11
25	25	893.145 "Drug paraphernalia" defined. —The term "drug 12
26	26	paraphernalia" means all equipment, products, and materials of 13
27	27	any kind which are used, intended for use, or designed for use 14
28	28	in planting, propagating, cultivating, growing, harvesting, 15
29	29	manufacturing, compounding, converting, producing, processing, 16
30	30	preparing, testing, analyzing, packaging, repackaging, storing, 17
31	31	containing, concealing, transporting, injecting, ingesting, 18
32	32	inhaling, or otherwise introducing into the human body a 19
33	33	controlled substance in violation of this chapter or s. 877.111. 20
34	34	Drug paraphernalia is deemed to be contraband which shall be 21
35	35	subject to civil forfeiture. The term includes, but is not 22
36	36	limited to: 23
37	37	(1) Kits used, intended for use, or designed for use in 24
38	38	the planting, propagating, cultivating, growing, or harvesting 25

52	52	which a controlled substance can be derived. 27
53	53	(2) Kits used, intended for use, or designed for use in 28
54	54	manufacturing, compounding, converting, producing, processing, 29
55	55	or preparing controlled substances. 30
56	56	(3) Isomerization devices used, intended for use, or 31
57	57	designed for use in increasing the potency of any species of 32
58	58	plant which is a controlled substance. 33
59	59	(4) Testing equipment used, intended for use, or designed 34
60	60	for use in identifying, or in analyzing the strength, 35
61	61	effectiveness, or purity of, controlled substances. 36
62	62	(4)(5) Scales and balances used, intended for use, or 37
63	63	designed for use in weighing or measuring controlled substances. 38
64	64	(5)(6) Diluents and adulterants, such as quinine 39
65	65	hydrochloride, caffeine, dimethyl sulfone, mannitol, mannite, 40
66	66	dextrose, and lactose, used, intended for use, or designed for 41
67	67	use in diluting controlled substances; or substances such as 42
68	68	damiana leaf, marshmallow leaf, and mullein leaf, used, intended 43
69	69	for use, or designed for use as carrie r mediums of controlled 44
70	70	substances. 45
71	71	(6)(7) Separation gins and sifters used, intended for use, 46
72	72	or designed for use in removing twigs and seeds from, or in 47
73	73	otherwise cleaning or refining, cannabis. 48

103	103	ceramic pipes, with or without screens, permanent screens, 66
104	104	hashish heads, or punctured metal bowls. 67

107	107	(d) Smoking and carburetion masks. 70
108	108	(e) Roach clips: meaning objects used to hold burning 71

163	163	(6) RETAIL SALE OF DRUG PARAPHERNALIA. — 102
164	164	(a) It is unlawful for a person to knowingly and willfully 103
165	165	sell or offer for sale at retail any drug paraphernalia 104
166	166	described in s. 893.145(11)(a)-(c) or (g)-(m) s. 893.145(12)(a)-105
167	167	(c) or (g)-(m), other than a pipe that is primarily made of 106
168	168	briar, meerschaum, clay, or corn cob. 107
169	169	Section 3. This act shall take effect July 1, 2022. 108
