106.08, F.S.; removing provisions that preempt 3
counties, municipalities, and other local governmental 4
entities from enacting or adopting limitations and 5
restrictions involving certain contributions and 6
expenditures or establishing contribution limits 7
different than those established in the Florida 8
Election Code; providing an effective date. 9

Be It Enacted by the Legislature of the State of Florida: 11

Section 1. Subsection (11) of section 106.08, Florida 13
Statutes, is amended to read: 14
106.08 Contributions; limitations on. — 15
(11)(a) A county, a municipality, or any other local 16
governmental entity is expressly preempted from enacting or 17
adopting: 18
1. Contribution limits that differ from the limitations 19
established in subsection (1); 20
2. Any limitation or restriction involving contributions 21
to a political committee or an electioneering communications 22
organization; or 23
3. Any limitation or restriction on expenditures for an 24
electioneering communication or an independent expenditure. 25

(b) Any existing or future limitation or restriction 26
enacted or adopted by a county, a municipality, or any other 27
local governmental entity which is in conflict with this 28
subsection is void. 29
Section 2. This act shall take effect July 1, 2022. 30
