2424 Be It Enacted by the Legislature of the State of Florida: 11

2626 Section 1. Subsections (1) and (6) of section 381.987, 13
2727 Florida Statutes, are amended to read: 14
2828 381.987 Public records exemption for personal identifying 15
2929 information relating to medical mariju ana held by the 16
3030 department.— 17
3131 (1) The following information held by the department is 18
3232 confidential and exempt from s. 119.07(1) and s. 24(a), Art. I 19
3333 of the State Constitution: 20
3434 (a) A patient's or caregiver's personal identifying 21
3535 information held by the department in the medical marijuana use 22
3636 registry established under s. 381.986 , including, but not 23
3737 limited to, the patient's or caregiver's name, address, date of 24
3838 birth, photograph, and telephone number . 25

5151 (b) All personal identifying information collected f or the 26
5252 purpose of issuing a patient's or caregiver's medical marijuana 27
5353 use registry identification card described in s. 381.986. 28
5454 (c) All personal identifying information pertaining to the 29
5555 physician certification for marijuana and the dispensing thereof 30
5656 held by the department, including, but not limited to, 31
5757 information related to the patient's diagnosis, exception 32
5858 requests to the daily dose amount limit, and the qualified 33
5959 patient's experience related to the medical use of marijuana . 34
6060 (d) A qualified physi cian's Drug Enforcement 35
6161 Administration number, residential address, and government -36
6262 issued identification card. 37
6363 (6) This section is subject to the Open Government Sunset 38
6464 Review Act in accordance with s. 119.15 and shall stand repealed 39
6565 on October 2, 2022, unless reviewed and saved from repeal 40
6666 through reenactment by the Legislature. 41
6767 Section 2. This act shall take effect October 1, 2022. 42
