16	16		Sunset Review Act; amending s. 119.071, F.S., which 3
17	17		provides an exemption from public records requirements 4
18	18		for criminal intelligence and criminal investigative 5
19	19		information that reveals the personal identifying 6
20	20		information of a witness to a murder for a specified 7
21	21		period; removing the scheduled repeal of the 8
22	22		exemption; providing an effective date. 9

24	24		Be It Enacted by the Legislature of the State of Florida: 11
25	25		12
26	26		Section 1. Paragraph (m) of subsection (2) of section 13
27	27		119.071, Florida Statutes, is amended to read: 14
28	28		119.071 General exemptions from inspection or copying of 15
29	29		public records.— 16
30	30		(2) AGENCY INVESTIGATION S.— 17
31	31		(m)1. Criminal intelligence information or criminal 18
32	32		investigative information that reveals the personal identifying 19
33	33		information of a witness to a murder, as described in s. 782.04, 20
34	34		is confidential and exempt from s. 119.07(1) and s. 24(a), Art. 21
35	35		I of the State Constitution for 2 years after the date on which 22
36	36		the murder is observed by the witness. A criminal justice agency 23
37	37		may disclose such information: 24
38	38		1.a. In the furtherance of its official duties and 25

52	52		2.b. To assist in locating o r identifying the witness if 27
53	53		the agency believes the witness to be missing or endangered. 28
54	54		3.c. To another governmental agency for use in the 29
55	55		performance of its official duties and responsibilities. 30
56	56		4.d. To the parties in a pending criminal prosecution as 31
57	57		required by law. 32
58	58		2. This paragraph is subject to the Open Government Sunset 33
59	59		Review Act in accordance with s. 119.15 and shall stand repealed 34
60	60		on October 2, 2022, unless reviewed and saved from repeal 35
61	61		through reenactment by the Legislature. 36
62	62		Section 2. This act shall take effect October 1, 2022. 37
