 Florida Senate - 2022 SB 250  By Senator Book 32-00483-22 2022250__ 1 A bill to be entitled 2 An act relating to removing memorializations of the 3 Confederate States of America; amending s. 256.051, 4 F.S.; deleting provisions prohibiting specified 5 improper uses or mutilation of the flag or emblem of 6 the Confederate States of America; making technical 7 changes; repealing s. 256.10, F.S., relating to the 8 mutilation of, or disrespect for, Confederate flags or 9 replicas thereof; amending s. 683.01, F.S.; removing 10 the designations of the birthdays of Robert E. Lee and 11 Jefferson Davis and Confederate Memorial Day as legal 12 holidays; providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1.Section 256.051, Florida Statutes, is amended to 17 read: 18 256.051Improper use or mutilation of state or Confederate 19 flag or emblem prohibited. 20 (1)It is shall be unlawful for any person, firm, or 21 corporation to copy, print, publish, or otherwise use the flag 22 or state emblem of Florida, or the flag or emblem of the 23 Confederate States, or any flag or emblem used by the 24 Confederate States or the military or naval forces of the 25 Confederate States at any time within the years 1860 to 1865, 26 both inclusive, for the purpose of advertising, selling, or 27 promoting the sale of any article of merchandise whatever within 28 this state. 29 (2)It shall also is be unlawful for any person, firm, or 30 corporation to mutilate, deface, defile, or contemptuously abuse 31 the flag or emblem of Florida or the flag or emblem of the 32 Confederate States by any act whatever. 33 (3)This section may not Nothing in this section shall be 34 construed to prevent the use of any flag, standard, color, 35 shield, ensign, or other insignia of Florida or of the 36 Confederate States for decorative or patriotic purposes. 37 Section 2.Section 256.10, Florida Statutes, is repealed. 38 Section 3.Subsection (1) of section 683.01, Florida 39 Statutes, is amended to read: 40 683.01Legal holidays. 41 (1)The legal holidays, which are also public holidays, are 42 the following: 43 (a)Sunday, the first day of each week. 44 (b)New Years Day, January 1. 45 (c)Birthday of Martin Luther King, Jr., January 15. 46 (d)Birthday of Robert E. Lee, January 19. 47 (e)Lincolns Birthday, February 12. 48 (e)(f)Susan B. Anthonys Birthday, February 15. 49 (f)(g)Washingtons Birthday, the third Monday in February. 50 (g)(h)Good Friday. 51 (h)(i)Pascua Florida Day, April 2. 52 (j)Confederate Memorial Day, April 26. 53 (i)(k)Memorial Day, the last Monday in May. 54 (l)Birthday of Jefferson Davis, June 3. 55 (j)(m)Flag Day, June 14. 56 (k)(n)Independence Day, July 4. 57 (l)(o)Labor Day, the first Monday in September. 58 (m)(p)Columbus Day and Farmers Day, the second Monday in 59 October. 60 (n)(q)Veterans Day, November 11. 61 (o)(r)General Election Day. 62 (p)(s)Thanksgiving Day, the fourth Thursday in November. 63 (q)(t)Christmas Day, December 25. 64 (r)(u)Shrove Tuesday, sometimes also known as Mardi 65 Gras, in counties where carnival associations are organized for 66 the purpose of celebrating the same. 67 Section 4.This act shall take effect July 1, 2022.
