Florida Senate - 2022 SB 256 By Senator Brodeur 9-00120B-22 2022256__ 1 A bill to be entitled 2 An act relating to animal cruelty; amending s. 828.12, 3 F.S.; revising the elements necessary for a 4 misdemeanor charge of animal cruelty; providing an 5 effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1.Subsection (1) of section 828.12, Florida 10 Statutes, is amended to read: 11 828.12Cruelty to animals. 12 (1)A person who: 13 (a)Unnecessarily kills, overloads, overdrives, torments, 14 or mutilates any animal, or causes the same to be done; 15 (b)Deprives any animal of necessary sustenance or 16 shelter;, or unnecessarily mutilates, or kills any animal, or 17 causes the same to be done, or 18 (c)Carries any animal in or upon any vehicle, or 19 otherwise, any animal in a cruel or inhumane manner, 20 21 commits animal cruelty, a misdemeanor of the first degree, 22 punishable as provided in s. 775.082 or by a fine of not more 23 than $5,000, or both. 24 Section 2.This act shall take effect October 1, 2022.
