Florida Senate - 2022 SB 1532 By Senator Ausley 3-01331-22 20221532__ 1 A bill to be entitled 2 An act relating to nursing home facility quality 3 assessments; amending s. 409.9082, F.S.; exempting 4 certain nursing home facility providers from quality 5 assessments; providing an effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1.Paragraph (a) of subsection (3) of section 10 409.9082, Florida Statutes, is amended to read: 11 409.9082Quality assessment on nursing home facility 12 providers; exemptions; purpose; federal approval required; 13 remedies. 14 (3)(a)The following nursing home facility providers are 15 exempt from the quality assessment: 16 1.Nursing home facilities that are licensed under part II 17 of chapter 400 and located on the campus of continuing care 18 retirement communities operating pursuant to a certificate of 19 authority under chapter 651.; 20 2.Nursing home facilities that have 45 or fewer beds.; and 21 3.The skilled nursing facility units of acute care 22 hospitals licensed by the agency under chapter 395. 23 4.Nursing home facilities that have 100 or more beds, are 24 designated as nonprofit organizations under s. 501(c)(3) of the 25 Internal Revenue Code, and are located within a metropolitan 26 statistical area with fewer than 500,000 residents which 27 includes at least one county designated as a rural area of 28 opportunity as defined in s. 288.0656(2). 29 Section 2.This act shall take effect July 1, 2022.
