5757 Be It Enacted by the Legislature of the State of Florid a: 32

5959 Section 1. Subsection (2) of section 553.79, Florida 34
6060 Statutes, is amended to read: 35
6161 553.79 Permits; applications; issuance; inspections. — 36
6262 (2)(a)1. Except as provided in subsection (8), an 37
6363 enforcing agency may not issue any permit for constructio n, 38
6464 erection, alteration, modification, repair, or demolition of any 39
6565 building or structure until the local building code 40
6666 administrator or inspector has reviewed the plans and 41
6767 specifications required by the Florida Building Code, or local 42
6868 amendment thereto, for such proposal and found the plans to be 43
6969 in compliance with the Florida Building Code. If the local 44
7070 building code administrator or inspector finds that the plans 45
7171 are not in compliance with the Florida Building Code, the local 46
7272 building code administrator or inspector shall identify the 47
7373 specific plan features that do not comply with the applicable 48
7474 codes, identify the specific code chapters and sections upon 49
7575 which the finding is based, and provide this information to the 50

8989 plans examiner, or inspector requests another local enforcing 52
9090 agency employee or a person contracted by the local enforcing 53
9191 agency to review the plans and that employee or person 54
9292 identifies specific plan features that do not comply with the 55
9393 applicable codes, the building code administrator, plans 56
9494 examiner, or inspector must provide this information to the 57
9595 local enforcing agency. The local enforcing agency shall provide 58
9696 this information to the permit applicant. 59
9797 2. In addition, An enforcing agency may not issue any 60
9898 permit for construction, erection, alteration, modification, 61
9999 repair, or demolition of any building until the appropriate 62
100100 firesafety inspector certified pursuant to s. 633.216 has 63
101101 reviewed the plans and specifications requir ed by the Florida 64
102102 Building Code, or local amendment thereto, for such proposal and 65
103103 found that the plans comply with the Florida Fire Prevention 66
104104 Code and the Life Safety Code. Any building or structure which 67
105105 is not subject to a firesafety code shall not be required to 68
106106 have its plans reviewed by the firesafety inspector. 69
107107 3. Any building or structure that is exempt from the local 70
108108 building permit process may not be required to have its plans 71
109109 reviewed by the local building code administrator. Industrial 72
110110 construction on sites where design, construction, and firesafety 73
111111 are supervised by appropriate design and inspection 74
112112 professionals and which contain adequate in -house fire 75

130130 4. The enforcing agency shall issue a permit to construct, 81
131131 erect, alter, modify, repair, or demolish any building or 82
132132 structure when the plans and specifications for such proposal 83
133133 comply with the Florida Building Code and the Florida Fire 84
134134 Prevention Code and the Life Safety Code as determined by the 85
135135 local authority in accor dance with this chapter and chapter 633. 86
136136 (b) After the local enforcing agency issues a permit, the 87
137137 local enforcing agency may not make or require any substantive 88
138138 changes to the plans or specifications except changes required 89
139139 for compliance with the Flori da Building Code, the Florida Fire 90
140140 Prevention Code, or the Life Safety Code, or local amendments 91
141141 thereto. If a local enforcing agency makes or requires 92
142142 substantive changes to the plans or specifications after a 93
143143 permit is issued, the local enforcing agency must identify the 94
144144 specific plan features that do not comply with the applicable 95
145145 codes, identify the specific code chapters and sections upon 96
146146 which the finding is based, and provide the information to the 97
147147 permitholder in writing. 98
148148 (c)1. A plans examiner or inspector who fails to provide 99

170170 Section 2. Subsection (2) of section 633.208, Florida 109
171171 Statutes, is amended to read: 110
172172 633.208 Minimum firesafety standards. — 111
173173 (2)(a) Pursuant to subsection (1), each municipality, 112
174174 county, and special district with firesafety responsibilities 113
175175 shall enforce the Florida Fire Prevention Code as the minimum 114
176176 firesafety code required by this section. 115
177177 (b) If a municipality, county, or special district 116
178178 determines that the building plans for a building permit 117
179179 application do not comply with the Florida Fir e Prevention Code 118
180180 or the Life Safety Code, or local amendments thereto, the local 119
