57	57		Be It Enacted by the Legislature of the State of Florid a: 32

59	59		Section 1. Subsection (2) of section 553.79, Florida 34
60	60		Statutes, is amended to read: 35
61	61		553.79 Permits; applications; issuance; inspections. — 36
62	62		(2)(a)1. Except as provided in subsection (8), an 37
63	63		enforcing agency may not issue any permit for constructio n, 38
64	64		erection, alteration, modification, repair, or demolition of any 39
65	65		building or structure until the local building code 40
66	66		administrator or inspector has reviewed the plans and 41
67	67		specifications required by the Florida Building Code, or local 42
68	68		amendment thereto, for such proposal and found the plans to be 43
69	69		in compliance with the Florida Building Code. If the local 44
70	70		building code administrator or inspector finds that the plans 45
71	71		are not in compliance with the Florida Building Code, the local 46
72	72		building code administrator or inspector shall identify the 47
73	73		specific plan features that do not comply with the applicable 48
74	74		codes, identify the specific code chapters and sections upon 49
75	75		which the finding is based, and provide this information to the 50

88	88		local enforcing agency. If the building code administrator, 51
89	89		plans examiner, or inspector requests another local enforcing 52
90	90		agency employee or a person contracted by the local enforcing 53
91	91		agency to review the plans and that employee or person 54
92	92		identifies specific plan features that do not comply with the 55
93	93		applicable codes, the building code administrator, plans 56
94	94		examiner, or inspector must provide this information to the 57
95	95		local enforcing agency. The local enforcing agency shall provide 58
96	96		this information to the permit applicant. 59
97	97		2. In addition, An enforcing agency may not issue any 60
98	98		permit for construction, erection, alteration, modification, 61
99	99		repair, or demolition of any building until the appropriate 62
100	100		firesafety inspector certified pursuant to s. 633.216 has 63
101	101		reviewed the plans and specifications requir ed by the Florida 64
102	102		Building Code, or local amendment thereto, for such proposal and 65
103	103		found that the plans comply with the Florida Fire Prevention 66
104	104		Code and the Life Safety Code. Any building or structure which 67
105	105		is not subject to a firesafety code shall not be required to 68
106	106		have its plans reviewed by the firesafety inspector. 69
107	107		3. Any building or structure that is exempt from the local 70
108	108		building permit process may not be required to have its plans 71
109	109		reviewed by the local building code administrator. Industrial 72
110	110		construction on sites where design, construction, and firesafety 73
111	111		are supervised by appropriate design and inspection 74
112	112		professionals and which contain adequate in -house fire 75

125	125		departments and rescue squads is exempt, subject to local 76
126	126		government option, from review o f plans and inspections, 77
127	127		providing owners certify that applicable codes and standards 78
128	128		have been met and supply appropriate approved drawings to local 79
129	129		building and firesafety inspectors. 80
130	130		4. The enforcing agency shall issue a permit to construct, 81
131	131		erect, alter, modify, repair, or demolish any building or 82
132	132		structure when the plans and specifications for such proposal 83
133	133		comply with the Florida Building Code and the Florida Fire 84
134	134		Prevention Code and the Life Safety Code as determined by the 85
135	135		local authority in accor dance with this chapter and chapter 633. 86
136	136		(b) After the local enforcing agency issues a permit, the 87
137	137		local enforcing agency may not make or require any substantive 88
138	138		changes to the plans or specifications except changes required 89
139	139		for compliance with the Flori da Building Code, the Florida Fire 90
140	140		Prevention Code, or the Life Safety Code, or local amendments 91
141	141		thereto. If a local enforcing agency makes or requires 92
142	142		substantive changes to the plans or specifications after a 93
143	143		permit is issued, the local enforcing agency must identify the 94
144	144		specific plan features that do not comply with the applicable 95
145	145		codes, identify the specific code chapters and sections upon 96
146	146		which the finding is based, and provide the information to the 97
147	147		permitholder in writing. 98
148	148		(c)1. A plans examiner or inspector who fails to provide 99
149	149		the building code administrator with the reasons for making or 100

167	167		requiring substantive changes to the plans or specifications is 106
168	168		subject to disciplinary action against his or her certificate 107
169	169		under s. 468.621(1)(i). 108
170	170		Section 2. Subsection (2) of section 633.208, Florida 109
171	171		Statutes, is amended to read: 110
172	172		633.208 Minimum firesafety standards. — 111
173	173		(2)(a) Pursuant to subsection (1), each municipality, 112
174	174		county, and special district with firesafety responsibilities 113
175	175		shall enforce the Florida Fire Prevention Code as the minimum 114
176	176		firesafety code required by this section. 115
177	177		(b) If a municipality, county, or special district 116
178	178		determines that the building plans for a building permit 117
179	179		application do not comply with the Florida Fir e Prevention Code 118
180	180		or the Life Safety Code, or local amendments thereto, the local 119
181	181		fire official must identify the specific plan features that do 120
182	182		not comply with the applicable codes, identify the specific code 121
183	183		chapters and sections upon which the determina tion is based, and 122
184	184		provide this information to the permit applicant. 123
185	185		(c) After a municipality, county, or special district 124

209	209		(d) A local fire official who is also a certified 136
210	210		firesafety inspector and who fails to comply with paragraph (b) 137
211	211		or paragraph (c) is subject to disciplinary action against his 138
212	212		or her certificate under s. 633.216(5)(f). 139
213	213		Section 3. This act shall take effect July 1, 2023. 140
