59 | 59 | | Section 1. Subsection (2) of section 553.79, Florida 34 |

62 | 62 | | (2)(a)1. Except as provided in subsection (8), an 37 |

63 | 63 | | enforcing agency may not issue any permit for constructio n, 38 |

64 | 64 | | erection, alteration, modification, repair, or demolition of any 39 |
---|
65 | 65 | | building or structure until the local building code 40 |
---|
66 | 66 | | administrator or inspector has reviewed the plans and 41 |
---|
67 | 67 | | specifications required by the Florida Building Code, or local 42 |
---|
68 | 68 | | amendment thereto, for such proposal and found the plans to be 43 |
---|
69 | 69 | | in compliance with the Florida Building Code. If the local 44 |
---|
70 | 70 | | building code administrator or inspector finds that the plans 45 |
---|
71 | 71 | | are not in compliance with the Florida Building Code, the local 46 |
---|
72 | 72 | | building code administrator or inspector shall identify the 47 |
---|
73 | 73 | | specific plan features that do not comply with the applicable 48 |
---|
74 | 74 | | codes, identify the specific code chapters and sections upon 49 |
---|

97 | 97 | | 2. In addition, An enforcing agency may not issue any 60 |

98 | 98 | | permit for construction, erection, alteration, modification, 61 |
---|
99 | 99 | | repair, or demolition of any building until the appropriate 62 |
---|
100 | 100 | | firesafety inspector certified pursuant to s. 633.216 has 63 |

101 | 101 | | reviewed the plans and specifications requir ed by the Florida 64 |

102 | 102 | | Building Code, or local amendment thereto, for such proposal and 65 |
---|
103 | 103 | | found that the plans comply with the Florida Fire Prevention 66 |
---|
104 | 104 | | Code and the Life Safety Code. Any building or structure which 67 |
---|
105 | 105 | | is not subject to a firesafety code shall not be required to 68 |
---|
106 | 106 | | have its plans reviewed by the firesafety inspector. 69 |
---|
107 | 107 | | 3. Any building or structure that is exempt from the local 70 |
---|
108 | 108 | | building permit process may not be required to have its plans 71 |
---|
109 | 109 | | reviewed by the local building code administrator. Industrial 72 |

135 | 135 | | local authority in accor dance with this chapter and chapter 633. 86 |

136 | 136 | | (b) After the local enforcing agency issues a permit, the 87 |

137 | 137 | | local enforcing agency may not make or require any substantive 88 |
---|
138 | 138 | | changes to the plans or specifications except changes required 89 |
---|
139 | 139 | | for compliance with the Flori da Building Code, the Florida Fire 90 |
