17	17		short title; defining the term "kratom product"; 4
18	18		prohibiting the sale, delivery, bartering, furnishing, 5
19	19		or giving of any kratom product to a person under 21 6
20	20		years of age; providing criminal penalties; requiring 7
21	21		the Department of Agriculture and Consumer Services to 8
22	22		adopt rules; providing an effective date. 9

24	24		Be It Enacted by the Legislature of the State of Florida: 11

26	26		Section 1. Section 500.92, Florida Statutes, is create d to 13
27	27		read: 14
28	28		500.92 Florida Kratom Consumer Protection Act. — 15
29	29		(1) This section may be cited as the "Florida Kratom 16
30	30		Consumer Protection Act." 17
31	31		(2) As used in this section, the term "kratom product" 18
32	32		means a food product, food ingredient, dietary ingredient , 19
33	33		dietary supplement, or beverage intended for human consumption 20
34	34		which contains any part of the leaf of the plant Mitragyna 21
35	35		speciosa or an extract, synthetic alkaloid, or synthetically 22
36	36		derived compound of such plant and is manufactured as a powder, 23
37	37		capsule, pill, beverage, or other edible form. 24
38	38		(3) It is unlawful to sell, deliver, barter, furnish, or 25

52	52		is under 21 years of age. 27
53	53		(4) A violation of subsection (3) is a misdemeanor of the 28
54	54		second degree, punishable as provided in s. 775.082 or s. 29
55	55		775.083. 30
56	56		(5) The department shall adopt rules to administer this 31
57	57		section. 32
58	58		Section 2. This act shall take effect July 1, 2023. 33
