30	30	Section 1. Subsections (1), (2), and (3) of section 17
31	31	784.048, Florida Statutes, are amended to read: 18
32	32	784.048 Stalking; definitions; penalties. — 19
33	33	(1) As used in this section, the term: 20
34	34	(a)(b) "Course of conduct" means a pattern of conduct 21
35	35	composed of a series of acts over a period of t ime, however 22
36	36	short, which evidences a continuity of purpose. The term does 23
37	37	not include constitutionally protected activity such as 24
38	38	picketing or other organized protests. 25

51	51	(b)(c) "Credible threat" means a verbal or nonverbal 26
52	52	threat, or a combination of the two, including threats delivered 27
53	53	by electronic communication or implied by a pattern of conduct, 28
54	54	which places the person who is the target of the threat in 29
55	55	reasonable fear for his or her safety or the safety of his or 30
56	56	her family members or individuals clo sely associated with the 31
57	57	person, and which is made with the apparent ability to carry out 32
58	58	the threat to cause such harm. It is not necessary to prove that 33
59	59	the person making the threat had the intent to actually carry 34
60	60	out the threat. The present incarcerati on of the person making 35
61	61	the threat is not a bar to prosecution under this section. 36
62	62	(c)(d) "Cyberstalk" means: 37
63	63	1. To engage in a course of conduct to communicate, or to 38
64	64	cause to be communicated, directly or indirectly, words, images, 39
65	65	or language by or through the use of electronic mail or 40
66	66	electronic communication, directed at or pertaining to a 41
67	67	specific person; or 42
68	68	2. To access, or attempt to access, the online accounts or 43
69	69	Internet-connected home electronic systems of another person 44
