126126 Section 1. Paragraph (e) of subsection (1) of section 77

128128 381.003 Communicable disease and AIDS prevention and 79
129129 control.— 80
130130 (1) The department shall conduct a communicable disease 81
131131 prevention and control program as part of fulfilling its public 82
132132 health mission. A communicable disease is any dis ease caused by 83
133133 transmission of a specific infectious agent, or its toxic 84
134134 products, from an infected person, an infected animal, or the 85
135135 environment to a susceptible host, either directly or 86
136136 indirectly. The communicable disease program must include, but 87
137137 need not be limited to: 88
138138 (e) Programs for the prevention and control of vaccine -89
139139 preventable diseases, including programs to immunize school 90
140140 children as required by s. 1003.22(3) -(11) and the development 91
141141 of an automated, electronic, and centralized database an d 92
142142 registry of immunizations. The department may not require 93
143143 enrollment in the immunization registry or otherwise require 94
144144 persons to submit to any form of immunization tracking. The 95
145145 department shall ensure that all children in this state are 96
146146 immunized against vaccine-preventable diseases. The immunization 97
147147 registry must allow the department to enhance current 98
148148 immunization activities for the purpose of improving the 99
149149 immunization of all children in this state. 100

162162 1. Except as provided in subparagraph 2., the dep artment 101
163163 shall include all children born in this state in the 102
164164 immunization registry by using the birth records from the Office 103
165165 of Vital Statistics. The department shall add other children to 104
166166 the registry as immunization services are provided. 105
167167 2. The parent or guardian of a child may refuse to have 106
168168 the child included in the immunization registry by signing a 107
169169 form obtained from the department, or from the health care 108
170170 practitioner or entity that provides the immunization, which 109
171171 indicates that the parent or gu ardian does not wish to have the 110
172172 child included in the immunization registry. Each consent to 111
173173 treatment form provided by a health care practitioner or by an 112
174174 entity that administers vaccinations or causes vaccinations to 113
175175 be administered to children from bir th through 17 years of age 114
176176 must contain a notice stating that the parent or guardian of a 115
177177 child may refuse to have his or her child included in the 116
178178 immunization registry. The parent or guardian may either submit 117
179179 the opt-out form directly to the department or must provide it 118
180180 such opt-out form to the health care practitioner or entity upon 119
181181 administration of the vaccination. Such health care practitioner 120
182182 or entity shall submit the form to the department. If a parent 121

201201 3. A college or university student, from 18 years of age 128
202202 to 23 years of age, who obtains a vaccination from a college or 129
203203 university student health center or clinic in this the state may 130
204204 refuse to be included in the immunization registry by signing a 131
205205 form obtained from the department, health center, or clinic 132
206206 which indicates that the student does not wish to be included in 133
207207 the immunization registry. The student may either submit the 134
208208 form directly to the department or must provide it such opt-out 135
209209 form to the health center or clinic upon administration of the 136
210210 immunization vaccination. Such health center or clinic shall 137

239239 5. A health care practitioner licensed under chapter 458, 154
240240 chapter 459, or chapter 464 in this state who administers 155
241241 vaccinations or causes vaccinations to be administered to 156
242242 children from birth through 17 years of age is required to 157
243243 report vaccination data to the immunization registry, unless a 158
244244 parent or guardian of a child has refused to have the child 159
245245 included in the immunization registry by meeting the 160
246246 requirements of subparagraph 2. A health care practitioner 161
247247 licensed under chapter 458, chapter 459, or chapter 464 in this 162
248248 state who administers vaccinations or causes vaccinations to be 163
249249 administered to college or university student s from 18 years of 164
250250 age to 23 years of age at a college or university student health 165
251251 center or clinic is required to report vaccination data to the 166
252252 immunization registry, unless the student has refused to be 167
253253 included in the immunization registry by meeting the 168
254254 requirements of subparagraph 3. Vaccination data for students in 169
255255 other age ranges may be submitted to the immunization registry 170
256256 only if the student consents to inclusion in the immunization 171
257257 registry. The upload of data from existing automated systems i s 172
258258 an acceptable method for updating immunization information in 173
259259 the immunization registry. The information in the immunization 174

274274 the child; the immunization record, including the date, type of 177
275275 administered vaccine, and vaccine lot number; and the presence 178
276276 or absence of any adverse reaction or contraindication related 179
277277 to the immunization. Information received by the department for 180
278278 the immunization registry retains its status as confidential 181
279279 medical information and the department must maintain the 182
280280 confidentiality of that information as otherwise required by 183
281281 law. A health care practitioner or other agency that obtains 184
282282 information from the immunization registry must maintain the 185
283283 confidentiality of any medical records in accordance with s. 186
284284 456.057 or as otherwise required by law. 187
285285 Section 2. Section 381.00316, Florida Statutes, is amended 188
286286 to read: 189
287287 381.00316 COVID-19 Vaccine documentation.— 190
288288 (1) A business entity, as defined in s. 768.38 to include 191
289289 any business operating in this state, may not require patrons or 192
290290 customers to provide any documentation certifying COVID-19 193
291291 vaccination or postinfection recovery from any disease to gain 194
292292 access to, entry upon, or service from the business operations 195
293293 in this state. This subsection does not otherwise restrict 196
294294 businesses from instituting screening protocols consistent with 197
295295 authoritative or controlling government -issued guidance to 198
296296 protect public health. 199
297297 (2) A governmental entity as defined in s. 768.38 may not 200

312312 access to, entry upon, or service from the governmental enti ty's 203
313313 operations in this state. This subsection does not otherwise 204
314314 restrict governmental entities from instituting screening 205
315315 protocols consistent with authoritative or controlling 206
316316 government-issued guidance to protect public health. 207
317317 (3) An educational institution as defined in s. 768.38 may 208
318318 not require students or residents to provide any documentation 209
319319 certifying COVID-19 vaccination or postinfection recovery from 210
320320 any disease for attendance or enrollment, or to gain access to, 211
321321 entry upon, or service from such educational institution in this 212
322322 state. This subsection does not otherwise restrict educational 213
323323 institutions from instituting screening protocols consistent 214
324324 with authoritative or controlling government -issued guidance to 215
325325 protect public health. This subsection does not apply to 216
326326 immunizations required by s. 1003.22(3). 217
327327 (4) The department may impose a fine not to exceed $5,000 218
328328 per violation. 219
329329 (5) This section does not apply to a health care provider 220
330330 as defined in s. 768.38; a servi ce provider licensed or 221
331331 certified under s. 393.17, part III of chapter 401, or part IV 222
332332 of chapter 468; or a provider with an active health care clinic 223
333333 exemption under s. 400.9935. However, such providers may not 224
334334 make the provision of any health care servic es contingent upon a 225

349349 (6) The department may adopt rules pursuant to ss. 120.536 228
350350 and 120.54 to implement this section. 229
351351 Section 3. Section 448.077, Florida Statutes, is created 230

353353 448.077 Employment discrimination on the basis of 232
354354 vaccination or immunity status prohibited. — 233
355355 (1) As used in this section, the term: 234
356356 (a) "Employee" means any individual who performs services 235
357357 for and under the direction and control of an employer for wages 236
358358 or other remuneration. The term includes independent 237
359359 contractors. 238
360360 (b) "Employer" means any individual, firm, partnership, 239
361361 institution, corporation, or association that employs two or 240
362362 more employees. The term includes governmental entities as 241
363363 defined in s. 768.38. 242
364364 (c) "Vaccination or immunity status," with respect to an 243
365365 individual, means whether he or she has been administered a 244
366366 vaccine for or is otherwise immune to a particular disease. 245
367367 (2) It is an unlawful employment practice for an employer 246
368368 to refuse to employ an individual, or to discharge, discipline, 247
369369 demote, or otherwise discriminate against an employee with 248
370370 respect to wages or terms, conditions, or privileges of 249
371371 employment, based on the individual's vaccination or immunity 250

391391 court may order any of the following relief, as applicable: 258
392392 (a) An injunction restraining continued violation of this 259

394394 (b) Employment or reinstatement of the employee to the 261
395395 same position applied for or held, as applicable, before the 262
396396 violation occurred or to an equivalent position. 263
397397 (c) Compensation for lost wages, benefits, and other 264
