2525 Be It Enacted by the Legislature of the State of Florida: 12

2727 Section 1. Paragraph (a) of subsection (2), paragraph (b) 14
2828 of subsection (3), and subsections (4), (5), and (6) of section 15
2929 491.019, Florida Statutes, as created by HB 343, 2023 Regular 16
3030 Session, are amended to read: 17
3131 491.019 Professional art therapy. - 18
3232 (2) The department shall issue a professional art 19
3333 therapist license to an applicant who the board certifies has 20
3434 met all of the following requirements: 21
3535 (a) Has submitted a completed application and paid a 22
3636 nonrefundable application fee set by rule of the board . 23

5151 therapist intern after the board certifies that he or she has 26
5252 met all of the follow ing requirements: 27
5353 1. Has submitted a completed application and paid a 28
5454 nonrefundable application fee set by rule of the board . 29
5555 2. Has completed the education requirements specified in 30
5656 paragraph (2)(b). 31
5757 3. Has submitted an acceptable supervision plan, as 32
5858 determined by rule of the board. 33
5959 4. Has identified a qualified supervisor, as determined by 34
6060 rule of the board. 35
6161 (4)(a) The department shall issue a license by endorsement 36
6262 to an applicant who the board certifies has met all of the 37
6363 following requiremen ts: 38
6464 1. Has submitted a completed application and paid a 39
6565 nonrefundable application fee set by rule of the board . 40
6666 2. Holds a professional art therapist license in good 41
6767 standing, or its equivalent, issued by another state or 42
6868 jurisdiction, if the qualifica tions for licensure in such other 43
6969 state or jurisdiction are equal to or greater than those 44
7070 specified in subsection (2). 45
7171 3. Has demonstrated, in a manner designated by rule of the 46
7272 board, knowledge of the laws and rules governing the practice of 47
7373 clinical social work, marriage and family therapy, mental health 48
7474 counseling, and professional art therapy. 49
7575 4. Has actively engaged in the practice of professional 50

8888 art therapy in such other state or jurisdiction for 3 of the 5 51
8989 years immediately preceding his or he r application for licensure 52
9090 by endorsement under this subsection. 53
9191 5. Is not under investigation for, and has not been found 54
9292 guilty of, any act that would constitute a violation of this 55
9393 chapter. 56
9494 (b) The department shall waive the requirements of 57
9595 subsection (2) and issue a professional art therapist license to 58
9696 an applicant who, before July 1, 2024, submits a completed 59
9797 application, pays a nonrefundable application fee set by rule of 60
9898 the board, and demonstrates to the board that he or she has met 61
9999 all of the following requirements: 62
100100 1. Has passed the Art Therapy Credentials Board 63
101101 Examination offered by the Art Therapy Credentials Board, Inc., 64
102102 or an examination offered by any successor organization. 65
103103 2. Has engaged in the practice of professional art therap y 66
104104 for at least 5 years, which may include up to 1 year of practice 67
105105 under supervision, as determined by rule of the board. 68
106106 3. Has completed appropriate training, as determined by 69
107107 rule of the board, in the assessment, diagnosis, treatment, or 70
108108 resolution of mental, behavioral, and emotional disorders and 71
109109 dysfunctions as part of the approved course of study for his or 72
110110 her master's or doctoral degree or following completion of such 73
111111 degree. 74

126126 clinical social work, marriage and family therapy, mental health 77
127127 counseling, and professional art therapy. 78
128128 5. Is not under investigation for, and has not been found 79
129129 guilty of, any act that would cons titute a violation of this 80
130130 chapter. 81
131131 (5)(a) The board or department shall adopt rules 82
132132 establishing requirements for the annual renewal of professional 83
133133 art therapist licenses at a fee set by rule of the board . 84
134134 (b)1. An applicant for license renewal shall present 85
135135 satisfactory evidence that, in the period since the license was 86
136136 issued, the applicant has completed continuing education 87
137137 requirements, as determined by rule of the board or department. 88
138138 2. The board or department shall require continuing 89
139139 education which must include, at a minimum, the continuing 90
140140 education requirements for maintaining national board 91
141141 certification in good standing with the Art Therapy Credentials 92
142142 Boards, Inc., or any successor organization. The board or 93
143143 department may not require mo re than 100 hours of continuing 94
144144 education in a 5-year period. 95
145145 (c) Continuing education providers, programs, and courses, 96
146146 and laws and rules governing such providers, programs, and 97
147147 courses, must be approved by the board or department as 98
148148 specified in s. 491.0085. 99
149149 (d) The board or department shall adopt rules establishing 100

164164 (6)(a) Inactive status is the licensure status that 103
165165 results when a licensee has applied to the department to be 104
166166 placed on inactive status and has paid a nonrefundable fee set 105
167167 by rule of the board . 106
168168 (b) An inactive license may be renewed annually by paying 107
169169 a nonrefundable fee set by rule of the board . 108
170170 (c) An inactive license ma y be reactivated by submitting a 109
171171 completed application to the department and paying a 110
172172 nonrefundable fee set by rule of the board . 111
173173 Section 2. This act shall take effect on the same date 112
174174 that HB 343 or other similar legislation takes effect , if such 113
175175 legislation is adopted in the same legislative session or an 114
176176 extension thereof and becomes law. 115
