22	22	registration renewal, inactive licenses, and license 9
23	23	reactivation; providing a contingent effective date. 10

25	25	Be It Enacted by the Legislature of the State of Florida: 12

27	27	Section 1. Paragraph (a) of subsection (2), paragraph (b) 14
28	28	of subsection (3), and subsections (4), (5), and (6) of section 15
29	29	491.019, Florida Statutes, as created by HB 343, 2023 Regular 16
30	30	Session, are amended to read: 17
31	31	491.019 Professional art therapy. - 18
32	32	(2) The department shall issue a professional art 19
33	33	therapist license to an applicant who the board certifies has 20
34	34	met all of the following requirements: 21
35	35	(a) Has submitted a completed application and paid a 22
36	36	nonrefundable application fee set by rule of the board . 23

51	51	therapist intern after the board certifies that he or she has 26
52	52	met all of the follow ing requirements: 27
53	53	1. Has submitted a completed application and paid a 28
54	54	nonrefundable application fee set by rule of the board . 29
55	55	2. Has completed the education requirements specified in 30
56	56	paragraph (2)(b). 31
57	57	3. Has submitted an acceptable supervision plan, as 32
58	58	determined by rule of the board. 33
59	59	4. Has identified a qualified supervisor, as determined by 34
60	60	rule of the board. 35
61	61	(4)(a) The department shall issue a license by endorsement 36
62	62	to an applicant who the board certifies has met all of the 37
63	63	following requiremen ts: 38
64	64	1. Has submitted a completed application and paid a 39
65	65	nonrefundable application fee set by rule of the board . 40
66	66	2. Holds a professional art therapist license in good 41
67	67	standing, or its equivalent, issued by another state or 42
68	68	jurisdiction, if the qualifica tions for licensure in such other 43
69	69	state or jurisdiction are equal to or greater than those 44
70	70	specified in subsection (2). 45
71	71	3. Has demonstrated, in a manner designated by rule of the 46
72	72	board, knowledge of the laws and rules governing the practice of 47
73	73	clinical social work, marriage and family therapy, mental health 48
74	74	counseling, and professional art therapy. 49
75	75	4. Has actively engaged in the practice of professional 50

88	88	art therapy in such other state or jurisdiction for 3 of the 5 51
89	89	years immediately preceding his or he r application for licensure 52
90	90	by endorsement under this subsection. 53
91	91	5. Is not under investigation for, and has not been found 54
92	92	guilty of, any act that would constitute a violation of this 55
93	93	chapter. 56
94	94	(b) The department shall waive the requirements of 57
95	95	subsection (2) and issue a professional art therapist license to 58
96	96	an applicant who, before July 1, 2024, submits a completed 59
97	97	application, pays a nonrefundable application fee set by rule of 60
98	98	the board, and demonstrates to the board that he or she has met 61
99	99	all of the following requirements: 62
100	100	1. Has passed the Art Therapy Credentials Board 63
101	101	Examination offered by the Art Therapy Credentials Board, Inc., 64
102	102	or an examination offered by any successor organization. 65
103	103	2. Has engaged in the practice of professional art therap y 66
104	104	for at least 5 years, which may include up to 1 year of practice 67
105	105	under supervision, as determined by rule of the board. 68
106	106	3. Has completed appropriate training, as determined by 69
107	107	rule of the board, in the assessment, diagnosis, treatment, or 70
108	108	resolution of mental, behavioral, and emotional disorders and 71
109	109	dysfunctions as part of the approved course of study for his or 72
110	110	her master's or doctoral degree or following completion of such 73
111	111	degree. 74
112	112	4. Has demonstrated, in a manner designated by rule of the 75

125	125	board, knowledge of the laws and rules governing the practice of 76
126	126	clinical social work, marriage and family therapy, mental health 77
127	127	counseling, and professional art therapy. 78
128	128	5. Is not under investigation for, and has not been found 79
129	129	guilty of, any act that would cons titute a violation of this 80
130	130	chapter. 81
131	131	(5)(a) The board or department shall adopt rules 82
132	132	establishing requirements for the annual renewal of professional 83
133	133	art therapist licenses at a fee set by rule of the board . 84
134	134	(b)1. An applicant for license renewal shall present 85
135	135	satisfactory evidence that, in the period since the license was 86
136	136	issued, the applicant has completed continuing education 87
137	137	requirements, as determined by rule of the board or department. 88
138	138	2. The board or department shall require continuing 89
139	139	education which must include, at a minimum, the continuing 90
140	140	education requirements for maintaining national board 91
141	141	certification in good standing with the Art Therapy Credentials 92
142	142	Boards, Inc., or any successor organization. The board or 93
143	143	department may not require mo re than 100 hours of continuing 94
144	144	education in a 5-year period. 95
145	145	(c) Continuing education providers, programs, and courses, 96
146	146	and laws and rules governing such providers, programs, and 97
147	147	courses, must be approved by the board or department as 98
148	148	specified in s. 491.0085. 99
149	149	(d) The board or department shall adopt rules establishing 100

163	163	registrations at a fee set by rule of the board . 102
164	164	(6)(a) Inactive status is the licensure status that 103
165	165	results when a licensee has applied to the department to be 104
166	166	placed on inactive status and has paid a nonrefundable fee set 105
167	167	by rule of the board . 106
168	168	(b) An inactive license may be renewed annually by paying 107
169	169	a nonrefundable fee set by rule of the board . 108
170	170	(c) An inactive license ma y be reactivated by submitting a 109
171	171	completed application to the department and paying a 110
172	172	nonrefundable fee set by rule of the board . 111
173	173	Section 2. This act shall take effect on the same date 112
174	174	that HB 343 or other similar legislation takes effect , if such 113
175	175	legislation is adopted in the same legislative session or an 114
176	176	extension thereof and becomes law. 115
