An act relating to conditions of pretrial release; 2
amending s. 903.047, F.S.; prohibiting a defendant 3
from having in his or her care, custody, possession, 4
or control a firearm or any ammunition if a court so 5
orders as a condition of pretrial release; providing 6
criminal penalties; providing an effective date. 7

Be It Enacted by the Legislature of the State of Florida: 9

Section 1. Subsection (3) is added t o section 903.047, 11
Florida Statutes, to read: 12
903.047 Conditions of pretrial release. — 13
(3) If a court orders a defendant to surrender his or her 14
firearms or ammunition or prohibits a defendant's possession of 15
firearms or ammunition as a condition of pr etrial release, it is 16
a violation of this section for the defendant to have in his or 17
her care, custody, possession, or control a firearm or any 18
ammunition. 19
Section 2. This act shall take effect October 1, 2023. 20
