25	25	personal identifying information; providing an 12
26	26	exception for a specified timeframe; providing an 13

29	29	Be It Enacted by the Legislature of the State of Florida: 16

31	31	Section 1. Section 395.1013, Florida Statutes, is created 18
32	32	to read: 19
33	33	395.1013 Unidentified persons. — 20
34	34	(1) Each hospital shall maintain a directory of all 21
35	35	unidentified persons being treated at the hospital which must be 22
36	36	made available to the public upon request. The directory must 23
37	37	include all of the following details for each unidentified 24

51	51	(a) The type of injury suffered by the unidentified 26
52	52	person. 27
53	53	(b) A description of the unidentified person's condition, 28
54	54	using general terms that do not disclose specific medical 29
55	55	information about the person. 30
56	56	(c) A description of distinguishing characteristics of the 31
57	57	unidentified person, including height, weight, gender, race, 32
58	58	hair and eye color, and any facial hair, scars, and tattoos. 33
59	59	(2) Before entering any information into the directory, a 34
60	60	hospital shall first inform the unidentified person that his or 35
61	61	her personal identifying information will be included in the 36
62	62	directory and may be disclosed to the public upon request. The 37
63	63	hospital shall provide the unidentified person with the 38
64	64	opportunity to restrict or prohibit the inclusion in the 39
65	65	directory of any of the information specified in subsection (1) 40
66	66	or the disclosure of such information. If an unidentified person 41
67	67	cannot reasonably be inf ormed of inclusion in the directory due 42
68	68	to the person's incapacitation or emergency treatment protocols, 43
69	69	the hospital must include the unidentified person in the 44
70	70	directory until the unidentified person is no longer 45
71	71	incapacitated or the emergency has subsid ed, at which point the 46
72	72	hospital must inform the unidentified person of his or her 47
73	73	inclusion in the directory and the option to restrict or 48
74	74	prohibit continued inclusion or the disclosure of his or her 49
75	75	personal identifying information. 50
