3131 Section 1. Section 395.1013, Florida Statutes, is created 18

3333 395.1013 Unidentified persons. — 20
3434 (1) Each hospital shall maintain a directory of all 21
3535 unidentified persons being treated at the hospital which must be 22
3636 made available to the public upon request. The directory must 23
3737 include all of the following details for each unidentified 24

5151 (a) The type of injury suffered by the unidentified 26

5353 (b) A description of the unidentified person's condition, 28
5454 using general terms that do not disclose specific medical 29

5656 (c) A description of distinguishing characteristics of the 31
5757 unidentified person, including height, weight, gender, race, 32
5858 hair and eye color, and any facial hair, scars, and tattoos. 33
5959 (2) Before entering any information into the directory, a 34
6060 hospital shall first inform the unidentified person that his or 35
6161 her personal identifying information will be included in the 36
6262 directory and may be disclosed to the public upon request. The 37
6363 hospital shall provide the unidentified person with the 38
6464 opportunity to restrict or prohibit the inclusion in the 39
6565 directory of any of the information specified in subsection (1) 40
6666 or the disclosure of such information. If an unidentified person 41
6767 cannot reasonably be inf ormed of inclusion in the directory due 42
6868 to the person's incapacitation or emergency treatment protocols, 43
6969 the hospital must include the unidentified person in the 44
7070 directory until the unidentified person is no longer 45
7171 incapacitated or the emergency has subsid ed, at which point the 46
7272 hospital must inform the unidentified person of his or her 47
7373 inclusion in the directory and the option to restrict or 48
7474 prohibit continued inclusion or the disclosure of his or her 49
