33	33	Section 1. Paragraph (a) of subsection (3) of section 20
34	34	201.15, Florida Statutes, is amended to read: 21
35	35	201.15 Distribution of ta xes collected.—All taxes 22
36	36	collected under this chapter are hereby pledged and shall be 23
37	37	first made available to make payments when due on bonds issued 24

51	51	authorized to be issued on a parity basis with suc h bonds. Such 26
52	52	pledge and availability for the payment of these bonds shall 27
53	53	have priority over any requirement for the payment of service 28
54	54	charges or costs of collection and enforcement under this 29
55	55	section. All taxes collected under this chapter, except taxes 30
56	56	distributed to the Land Acquisition Trust Fund pursuant to 31
57	57	subsections (1) and (2), are subject to the service charge 32
58	58	imposed in s. 215.20(1). Before distribution pursuant to this 33
59	59	section, the Department of Revenue shall deduct amounts 34
60	60	necessary to pay the costs of the collection and enforcement of 35
61	61	the tax levied by this chapter. The costs and service charge may 36
62	62	not be levied against any portion of taxes pledged to debt 37
63	63	service on bonds to the extent that the costs and service charge 38
64	64	are required to pay an y amounts relating to the bonds. All of 39
65	65	the costs of the collection and enforcement of the tax levied by 40
66	66	this chapter and the service charge shall be available and 41
67	67	transferred to the extent necessary to pay debt service and any 42
68	68	other amounts payable with r espect to bonds authorized before 43
69	69	January 1, 2017, secured by revenues distributed pursuant to 44
70	70	this section. All taxes remaining after deduction of costs shall 45
71	71	be distributed as follows: 46
72	72	(3) Amounts on deposit in the Land Acquisition Trust Fund 47
73	73	shall be used in the following order: 48
74	74	(a) Payment of debt service or funding of debt service 49

88	88	respect to Florida Forever bonds issued pursuant to s. 215.618. 51
89	89	The amount used for such purposes may not exceed $300 million in 52
90	90	each fiscal year. It is the intent of the Legislature that all 53
91	91	bonds issued to fund the Florida Forever Act be retired by 54
92	92	December 31, 2054 2040. Except for bonds issued to refund 55
93	93	previously issued bonds, a no series of bonds may not be issued 56
94	94	pursuant to this paragraph unless such bonds are approved and 57
95	95	the debt service for the remainder of the fiscal year in which 58
96	96	the bonds are issued is specifically appropriated in the General 59
97	97	Appropriations Act or other law with respect to bonds issued for 60
98	98	the purposes of s. 373.4598. 61

100	100	Bonds issued pursuant to s. 215.618 or s. 215.619 are equally 63
101	101	and ratably secured by moneys distributable to the Land 64
102	102	Acquisition Trust Fund. 65
103	103	Section 2. Subsections (3), (4), (7), (9), and (16) of 66
104	104	section 259.105, Florida Statutes, are amended to read: 67
105	105	259.105 The Florida Forever Act. — 68
106	106	(3) Less the costs of issuing and the costs of funding 69
107	107	reserve accounts and other costs associated with bonds, the 70
108	108	proceeds of cash payments or bonds issued pursuant to this 71
109	109	section shall be deposited into the Florida Forever Trust Fund 72
110	110	created by s. 259.1051. The proceeds shall be distributed by the 73
111	111	Department of Environmental Protection in the following manner: 74

126	126	expenditures necessary to implement the water management 77
127	127	districts' priority lists developed pursuant to s. 373.199. The 78
128	128	funds are to be distributed to the water management districts as 79
129	129	provided in subsecti on (11). A minimum of 50 percent of the 80
130	130	total funds provided over the life of the Florida Forever 81
131	131	program pursuant to this paragraph shall be used for the 82
132	132	acquisition of lands. 83
133	133	(a)(b) Thirty-five percent to the Department of 84
134	134	Environmental Protection for the acquisition of lands and 85
135	135	capital project expenditures described in this section. Of the 86
136	136	proceeds distributed pursuant to this paragraph, it is the 87
137	137	intent of the Legislature that an increased priority be given to 88
138	138	those acquisitions which achieve a combi nation of conservation 89
139	139	goals, including protecting Florida's water resources and 90
140	140	natural groundwater recharge. At a minimum, 3 percent, and no 91
141	141	more than 10 percent, of the funds allocated pursuant to this 92
142	142	paragraph shall be spent on capital project expendi tures 93
143	143	identified during the time of acquisition which meet land 94
144	144	management planning activities necessary for public access. 95
145	145	Beginning in the 2017 -2018 fiscal year and continuing through 96
146	146	the 2026-2027 fiscal year, at least $5 million of the funds 97
147	147	allocated pursuant to this paragraph shall be spent on land 98
148	148	acquisition within the Florida Keys Area of Critical State 99
149	149	Concern as authorized pursuant to s. 259.045. 100

164	164	Trust for the purposes of part III of chapter 380, as described 103
165	165	and limited by this subsection, and grants to local governments 104
166	166	or nonprofit environmental organizations that are tax -exempt 105
167	167	under s. 501(c)(3) of the United States Internal Rev enue Code 106
168	168	for the acquisition of community -based projects, urban open 107
169	169	spaces, parks, and greenways to implement local government 108
170	170	comprehensive plans. From funds available to the trust and used 109
171	171	for land acquisition, 75 percent shall be matched by local 110
172	172	governments on a dollar-for-dollar basis. The Legislature 111
173	173	intends that the Florida Communities trust emphasize funding 112
174	174	projects in low-income or otherwise disadvantaged communities 113
175	175	and projects that provide areas for direct water access and 114
176	176	water-dependent facilities that are open to the public and offer 115
177	177	public access by vessels to waters of the state, including boat 116
178	178	ramps and associated parking and other support facilities . At 117
179	179	least 30 percent of the total allocation provided to the trust 118
180	180	shall be used in Stan dard Metropolitan Statistical Areas, but 119
181	181	one-half of that amount shall be used in localities in which the 120
182	182	project site is located in built -up commercial, industrial, or 121
183	183	mixed-use areas and functions to intersperse open spaces within 122
184	184	congested urban core ar eas. Up to 2 percent of the total 123
185	185	allocation provided to the trust may be used for expenditures 124
186	186	necessary to implement the Stan Mayﬁeld Working Waterfronts 125

199	199	program pursuant to s. 380.5105 From funds allocated to the 126
200	200	trust, no less than 5 percent shall be u sed to acquire lands for 127
201	201	recreational trail systems, provided that in the event these 128
202	202	funds are not needed for such projects, they will be available 129
203	203	for other trust projects . Local governments may use federal 130
204	204	grants or loans, private donations, or environm ental mitigation 131
205	205	funds for any part or all of any local match required for 132
206	206	acquisitions funded through the Florida Communities trust. Any 133
207	207	lands purchased by nonprofit organizations using funds allocated 134
208	208	under this paragraph must provide for such lands to r emain 135
209	209	permanently in public use through a reversion of title to local 136
210	210	or state government, conservation easement, or other appropriate 137
211	211	mechanism. Projects funded with funds allocated to the trust 138
212	212	shall be selected in a competitive process measured against 139
213	213	criteria adopted in rule by the trust. 140
214	214	(c)(d) Two percent to the Department of Environmental 141
215	215	Protection for grants pursuant to s. 375.075. 142
216	216	(d)(e) Two One and five-tenths percent to the Department 143
217	217	of Environmental Protection for the purchase of inholdings and 144
218	218	additions to state parks and for capital project expenditures as 145
219	219	described in this section. At a minimum, 1 percent, and no more 146
220	220	than 10 percent, of the funds allocat ed pursuant to this 147
221	221	paragraph shall be spent on capital project expenditures 148
222	222	identified during the time of acquisition which meet land 149

237	237	real property in the state which is under the jurisdiction of 152
238	238	the Division of Recreation and Parks of the department, or which 153
239	239	may come under its jurisdiction. 154
240	240	(e)(f) Two One and five-tenths percent to the Florida 155
241	241	Forest Service of the Department of Agriculture and Consumer 156
242	242	Services to fund the acquisition of state forest inholdings and 157
243	243	additions pursuant to s. 589.07, the implementation of 158
244	244	reforestation plans or sustainable forestry management 159
245	245	practices, and for capital project expenditures as des cribed in 160
246	246	this section. At a minimum, 1 percent, and no more than 10 161
247	247	percent, of the funds allocated for the acquisition of 162
248	248	inholdings and additions pursuant to this paragraph shall be 163
249	249	spent on capital project expenditures identified during the time 164
250	250	of acquisition which meet land management planning activities 165
251	251	necessary for public access. 166
252	252	(f)(g) Two One and five-tenths percent to the Fish and 167
253	253	Wildlife Conservation Commission to fund the acquisition of 168
254	254	inholdings and additions to lands managed by the commi ssion 169
255	255	which are important to the conservation of fish and wildlife and 170

287	287	acquisition of agricultural lands, through perpetual 190
288	288	conservation easements and other perpetual less tha n fee 191
289	289	techniques, which will achieve the objectives of Florida Forever 192
290	290	and s. 570.71. Rules concerning the application, acquisition, 193
291	291	and priority ranking process for such easements shall be 194
292	292	developed pursuant to s. 570.71(10) and as provided by this 195
293	293	paragraph. The board shall ensure that such rules are consistent 196
294	294	with the acquisition process provided for in s. 570.715. The 197
295	295	rules developed pursuant to s. 570.71(10), shall also provide 198

331	331	Florida Forever bonds unde r this section may not maintain a 222
332	332	balance of unencumbered funds in its Florida Forever subaccount 223
333	333	beyond 3 fiscal years from the date of deposit of funds from 224

350	350	(j)(l) For the purposes of paragraphs (e), (f), and (g), 229
351	351	and (h), the agencies that receive the funds shall develop their 230
352	352	individual acquisition or restoration lists in accordance with 231
353	353	specific criteria and numeric performance measures developed 232
354	354	pursuant to s. 259.035(4). Proposed additions may be acquired if 233
355	355	they are identified within the original project boundary, the 234
356	356	management plan required pursuant to s. 253.034(5), or the 235
357	357	management prospectus required pursuant to s. 259.032(7)(c). 236
358	358	Proposed additions not meeting the requirements of this 237
359	359	paragraph shall be submitted to the council for approval. The 238
360	360	council may only approve the proposed addition if it meets two 239
361	361	or more of the following criteria: serves as a link or corridor 240
362	362	to other publicly owned property; enhances the protection or 241
363	363	management of the property; would add a desirable resource to 242
364	364	the property; would create a more m anageable boundary 243
365	365	configuration; has a high resource value that otherwise would be 244
366	366	unprotected; or can be acquired at less than fair market value. 245
367	367	(m) Notwithstanding paragraphs (a) -(j) and for the 2021 -246
368	368	2022 fiscal year, the amount of $1,998,100 to only the 247
369	369	Department of Environmental Protection for grants pursuant to s. 248
370	370	375.075. This paragraph expires July 1, 2022. 249

621	621	incremental improvements the project accomplishes towards 416

623	623	2. Proof that property owners within any proposed 418
624	624	acquisition have been notified of their inclusion in the 419
625	625	proposed project. Any property owner may request the removal of 420
626	626	such property from further consideration by submitting a request 421
627	627	to the project sponsor or the Acquisition and Restoration 422
628	628	Council by certified mail. Upon receiving this request, the 423
629	629	council shall delete the property from the proposed project; 424

845	845	purposes in a fiscal year are in addition to the amount 568

1051	1051	are subject to such terms and conditions imposed thereon by the 702
1052	1052	agency of the state responsible for the bonds, the proceeds of 703

1098	1098	(d) On behalf of the board of trustees and before the 737
1099	1099	appraisal of parcels approved for purchase under ss. 738
1100	1100	259.105(3)(h) ss. 259.105(3)(i) and 570.71, the department may 739
1101	1101	enter into option contracts to buy less than fee simple interest 740
1102	1102	in such parcels. Any such option contract shall state that the 741
1103	1103	final purchase price is subject to approval by the board of 742
1104	1104	trustees and that the final purc hase price may not exceed the 743
1105	1105	maximum offer authorized by law. Any such option contract 744
1106	1106	presented to the board of trustees for final purchase price 745
1107	1107	approval shall explicitly state that payment of the final 746
1108	1108	purchase price is subject to an appropriation by t he 747
1109	1109	Legislature. The consideration for any such option contract may 748
1110	1110	not exceed $1,000 or 0.01 percent of the estimate by the 749
1111	1111	department of the value of the parcel, whichever amount is 750
