24	24	terms; prohibiting the imposition of cost -sharing 11
25	25	requirements for diagnostic and supplemental breast 12
26	26	examinations by individual accident and health 13
27	27	insurance policies; group, blanket, and franchise 14
28	28	accident or health insurance policies; and health 15
29	29	maintenance contracts, respectively, which provide 16
30	30	such coverage; authorizing the Financial Services 17
31	31	Commission to adopt rules; providing an effective 18

36	36	Section 1. Subsection (15) is added to section 110.123, 23
37	37	Florida Statutes, to read: 24

51	51	(15) COVERAGE FOR DIAGNOSTIC AND SUPPLEMENTAL BREAST 26
52	52	EXAMINATIONS.—The state group insurance program may not impose 27
53	53	any enrollee cost-sharing liability with respect to coverage for 28
54	54	diagnostic breast examinations and supplemental breast 29
55	55	examinations. As used in this subsection, the terms "diagnostic 30
56	56	breast examination" and "supplemental breast examination" have 31
57	57	the same meanings as in s. 627.64181(1). 32
58	58	Section 2. Section 627.64181, Florida Statutes, is created 33
59	59	to read: 34
60	60	627.64181 Coverage for diagnostic and supplemental breast 35
61	61	examinations; cost-sharing requirements prohibited. — 36
62	62	(1) As used in this section, the term: 37
63	63	(a) "Cost-sharing requirement" means an insured's 38
64	64	deductible, coinsurance, copayment, or other out -of-pocket 39
65	65	expense. 40
66	66	(b) "Diagnostic breast examination" means a medically 41
67	67	necessary and appropriate examination of the breast, including 42
68	68	an examination using dia gnostic mammography, breast magnetic 43
69	69	resonance imaging, or breast ultrasound, which is used to 44
70	70	evaluate an abnormality: 45
71	71	1. Seen or suspected from a screening examination for 46
72	72	breast cancer; or 47
73	73	2. Detected by another means of examination. 48
74	74	(c) "Supplemental breast examination" means a medically 49
75	75	necessary and appropriate examination of the breast, including 50

88	88	an examination using breast magnetic resonance imaging or breast 51
89	89	ultrasound, which is: 52
90	90	1. Used to screen for breast cancer when there is no 53
91	91	abnormality seen or suspected; and 54
92	92	2. Based on personal or family medical history or 55
93	93	additional factors that may increase the individual's risk of 56
94	94	breast cancer. 57
95	95	(2) An accident or health insurance policy issued, 58
96	96	amended, delivered, or renewed on or after January 1, 2024, 59
97	97	which provides coverage for diagnostic breast examinations and 60
98	98	supplemental breast examinations shall not impose any cost -61
99	99	sharing requirement with respect to such coverage. 62
100	100	(3) The commission may adopt rules to administer this 63
101	101	section. 64

143	143	delivered, or renewed on or after January 1, 2024, which 94
144	144	provides coverage for diagnostic breast examinations and 95
145	145	supplemental breast examinations shall not impose any cost -96
146	146	sharing requirement with respect to such covera ge. 97
147	147	(3) The commission may adopt rules to administer this 98
148	148	section. 99
149	149	Section 5. This act shall take effect July 1, 2023. 100
