88- (a) Penis and a vulva or an anus; or 51
89- (b) Mouth and a penis, a vulva, or an anus. 52
90- (4) "Sexually transmissible disease" means a bacterial, 53
91-viral, fungal, or parasitic disease determined by rule of the 54
92-department to be sexually transmissible, to be a threat to the 55
93-public health and welfare, and to be a disease for which a 56
94-legitimate public interest will be served by providing for 57
95-prevention, elimination, control, and treatment. The department 58
96-must, by rule, determine which diseases are to be designated as 59
97-sexually transmissible diseases and shall consider the 60
98-recommendations and classifications of the Center s for Disease 61
99-Control and Prevention and other nationally recognized medical 62
100-authorities in that determination. Not all diseases that are 63
101-sexually transmissible need be designated for the purposes of 64
102-this act. 65
103- (5) "Substantial risk of transmission" means a reasonable 66
104-probability of disease transmission as proven by competent 67
105-medical evidence. 68
106- Section 4. Section 384.24, Florida Statutes, is amended to 69

137-informed that he or she may communicate this disease to another 88
138-person through sexual intercourse, to have sexual intercourse 89
139-with any other person, unless such other person has been 90
140-informed of the presence of the sexually transmissible disease 91
141-and has consented to the sexual intercourse. 92

140+the sexually transmissible disease and has consented to the 91
141+sexual intercourse. 92
142+ (2) A person does not act with the intent required under 93
143+subsection (1) if he or she in good faith complies with a 94
144+treatment regimen prescribed by his or her health care provider 95
145+or with the behavioral recommenda tions of his or her health care 96
146+provider or public health officials to limit the risk of 97
147+transmission, or if he or she offers to comply with such 98
148+behavioral recommendations but such offer is rejected by the 99
149+other person with whom he or she is engaging in s exual conduct. 100

163-775.082, s. 775.083, or s. 775.084. Any person who commits a 102
164-second or subsequent violation of s. 384.24 multiple violations 103
165-of s. 384.24(2) commits a felony of the third first degree, 104
166-punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 105
167- (2) Any person who violates the provisions of s. 384.26 or 106
168-s. 384.29 commits a misdemeanor of the first degree, punishable 107

170- (3) Any person who maliciously disseminates any false 109
171-information or report concerning the existence of any sexually 110
172-transmissible disease commits a felony of the third degree, 111
173-punishable as provided in ss. 775.082, 775.083, and 775.084. 112
174- (4) Any person who violates th e provisions of the 113
175-department's rules pertaining to sexually transmissible diseases 114
176-may be punished by a fine not to exceed $500 for each violation. 115
177-Any penalties enforced under this subsection shall be in 116
178-addition to other penalties provided by this chap ter. The 117
179-department may enforce this section and adopt rules necessary to 118
180-administer this section. 119
181- (4)(6) Any person who obtains information that identifies 120
182-an individual who has a sexually transmissible disease, who knew 121
183-or should have known the nature of the information, and 122
184-maliciously, or for monetary gain, disseminates this information 123
185-or otherwise makes this information known to any other person, 124
186-except by providing it either to a physician or nurse employed 125
162+For purposes of this subsection, the term "behavioral 101
163+recommendations" includes, but is not limited to, the use of a 102
164+prophylactic device to limit the risk of transmission of the 103
165+disease. Evidence of the person's failure to comply with such a 104
166+treatment regimen or such behavioral recommendations is not, in 105
167+and of itself, sufficient to establish that he or she acted with 106
168+the intent required under subsection (1) It is unlawful for any 107

276- (3) An offender who has undergone HIV testing pursuant to 179
277-subsection (1), and to whom positive test results have been 180
278-disclosed pursuant to subsection (2), who commits a second or 181
279-subsequent offense enumerated in paragraphs (1)(a)-(m) (1)(a)-182
280-(n), commits criminal transmission of HIV, a misdemeanor of the 183
281-first felony of the third degree, punishable as provided in s. 184
282-775.082 or, s. 775.083, or s. 775.084. A person may be convicted 185
283-and sentenced separately for a violation of this subsection and 186
284-for the underlying crime enumerated in paragraphs (1)(a)-(m) 187
285-(1)(a)-(n). 188
286- (6) For an alleged violation of any offense enumerated in 189
287-paragraphs (1)(a)-(m) (1)(a)-(n) for which the consent of the 190
288-victim may be raised as a defense in a crimin al prosecution, it 191
289-is an affirmative defense to a charge of violating this section 192
290-that the person exposed knew that the offender was infected with 193
291-HIV, knew that the action being taken could result in 194
292-transmission of the HIV infection, and consented to th e action 195
293-voluntarily with that knowledge. 196

813+to the person convic ted of or adjudicated delinquent for any 327

815+(n), which involves the transmission of body fluids from one 329
816+person to another, and, upon request, to the victim or the 330
817+victim's legal guardian, or the p arent or legal guardian of the 331
818+victim if the victim is a minor, and to public health agencies 332
819+pursuant to s. 775.0877. If the alleged offender is a juvenile, 333
820+the test results shall also be disclosed to the parent or 334
821+guardian. When the victim is a victim as described in paragraph 335
822+(2)(b), the test results must also be disclosed no later than 2 336
823+weeks after the court receives such results, to the person 337
