A bill to be entitled 1 
An act relating to intravenous vitamin treatment; 2 
providing a short title; creating s. 464.0124, F.S.; 3 
providing a definition; requiring the Board of Nursing 4 
to adopt rules establishing procedures to administer 5 
certain intravenous treatment and emergency protocols; 6 
providing requirements for persons administering such 7 
treatment; providing an effective date. 8 
 9 
Be It Enacted by the Legislature of the State of Flo rida: 10 
 11 
 Section 1.  This act may be cited as the "Stephanie Balais 12 
Act." 13 
 Section 2.  Section 464.0124, Florida Statutes, is created 14 
to read: 15 
 464.0124  Administering intravenous vitamin treatment. — 16 
 (1)  "Intravenous vitamin treatment" means a procedu re in 17 
which high concentrations of vitamins and minerals are 18 
administered directly into the person's bloodstream, allowing 19 
rapid absorption of higher doses of the vitamins and minerals 20 
than if received through food or supplements. 21 
 (2)  The board shall ado pt rules establishing procedures to 22 
safely administer intravenous vitamin treatment and establish 23 
protocols to follow in the event of an emergency that would 24 
place the life or health of a recipient of such treatment in 25

danger. The rules shall include requi rements for all of the 26 
following: 27 
 (a)  Education and training requirements to administer 28 
intravenous vitamin treatment. 29 
 (b)  Self-screening risk assessments. 30 
 (c)  Information that a person administering intravenous 31 
vitamin treatment must provide to a cl ient before administering 32 
such treatment. 33 
 (d)  Documentation regarding the process of administering 34 
intravenous vitamin treatment. 35 
 (e)  Notification that must be provided to a client's 36 
designated physician that an intravenous vitamin treatment was 37 
administered. 38 
 (f)  Evaluation and review of the administration practices 39 
used to administer intravenous vitamin treatment. 40 
 (3)  For a new client requesting intravenous vitamin 41 
treatment, and at least every 6 months for each returning 42 
client, a person administe ring intravenous vitamin treatment 43 
must do all of the following: 44 
 (a)  Obtain a complete self -screening risk assessment. 45 
 (b)  Perform a client assessment. 46 
 (c)  Provide the client with a visit summary. 47 
 (d)  Advise the client to seek medical help in case of an 48 
emergency. 49 
 (4)  A person administering intravenous vitamin treatment 50

shall: 51 
 (a)  Obtain a complete self -screening risk assessment 52 
questionnaire that has been approved by the board from the 53 
client before administering intravenous vitamin treatment. If 54 
the results of the assessment indicate that it is unsafe to 55 
administer to the client, the procedure may not be performed. 56 
 (b)  Provide the client with the following information: 57 
 1.  Any potential side effects and risks of intravenous 58 
vitamin treatment. 59 
 2.  Instructions on when to seek medical attention. 60 
 (c)  Have a written plan for the appropriate provision of 61 
emergency care. A copy of the emergency plan must be kept at the 62 
location offering intravenous vitamin treatment. The plan must 63 
include the following: 64 
 1.  The name and address of hospital closest to the 65 
location at which the intravenous vitamin treatment is being 66 
performed. 67 
 2.  Reasons for which an emergency transfer of a client may 68 
be required. 69 
 3.  Medical services to be used in the event o f an 70 
emergency that would place the life or health of a client in 71 
serious jeopardy.  72 
 Section 3.  This act shall take effect July 1, 2023. 73
