27- Section 1. This act may be cited as the "Stephanie Balais 14
28-Act." 15
29- Section 2. Section 456.0302, Florida Statutes, is created 16
30-to read: 17
31- 456.0302 Administering intravenous vitamin treatment. 18
32- (1) As used in this section, the term: 19
33- (a) "Health care provider" means a person licensed under 20
34-chapter 458, chapter 459, or chapter 464. 21
35- (b) "Intravenous vitamin treatment" means a procedure in 22
36-which high concentrations of vitamins and minerals are 23
37-administered directly into a person's bloodstream, allowing 24
38-rapid absorption of higher doses of the vitamins and minerals 25
25+ Section 1. This act may be cited as the "Stephanie Balais 12

27+ Section 2. Section 464.0124, Florida Statutes, is created 14
28+to read: 15
29+ 464.0124 Administering intravenous vitamin treatment. 16
30+ (1) "Intravenous vitamin treatment" means a procedu re in 17
31+which high concentrations of vitamins and minerals are 18
32+administered directly into the person's bloodstream, allowing 19
33+rapid absorption of higher doses of the vitamins and minerals 20
34+than if received through food or supplements. 21
35+ (2) The board shall ado pt rules establishing procedures to 22
36+safely administer intravenous vitamin treatment and establish 23
37+protocols to follow in the event of an emergency that would 24
38+place the life or health of a recipient of such treatment in 25

51-than if received through food or supplements. 26
52- (2) A health care provider adminis tering intravenous 27
53-vitamin treatment shall: 28
54- (a) Obtain a complete self -screening risk assessment 29
55-questionnaire from a patient before administering intravenous 30
56-vitamin treatment. The health care provider must use a form 31
57-adopted by rule by the applicable b oard. 32
58- (b) Provide a patient with information related to 33
59-potential side effects and risks of intravenous vitamin 34
60-treatment and instructions on when to seek medical attention. 35
61- (c) Provide a patient with a visit summary. 36
62- (d) Notify a patient's designat ed physician that an 37
63-intravenous vitamin treatment was administered. 38
64- (e) Have a written plan for the provision of emergency 39
65-care. A copy of the emergency plan must be kept at the location 40
66-offering intravenous vitamin treatment. The plan must include 41
67-the following: 42
68- 1. The name and address of the hospital closest to the 43
69-location at which the intravenous vitamin treatment is being 44
70-performed. 45
71- 2. Reasons for which an emergency transfer of a patient 46
72-may be required. 47
73- 3. Medical services to be used in the e vent of a health 48
51+danger. The rules shall include requi rements for all of the 26
52+following: 27
53+ (a) Education and training requirements to administer 28
54+intravenous vitamin treatment. 29
55+ (b) Self-screening risk assessments. 30
56+ (c) Information that a person administering intravenous 31
57+vitamin treatment must provide to a cl ient before administering 32
58+such treatment. 33
59+ (d) Documentation regarding the process of administering 34
60+intravenous vitamin treatment. 35
61+ (e) Notification that must be provided to a client's 36
62+designated physician that an intravenous vitamin treatment was 37
63+administered. 38
64+ (f) Evaluation and review of the administration practices 39
65+used to administer intravenous vitamin treatment. 40
66+ (3) For a new client requesting intravenous vitamin 41
67+treatment, and at least every 6 months for each returning 42
68+client, a person administe ring intravenous vitamin treatment 43
69+must do all of the following: 44
70+ (a) Obtain a complete self -screening risk assessment. 45
71+ (b) Perform a client assessment. 46
72+ (c) Provide the client with a visit summary. 47
73+ (d) Advise the client to seek medical help in case of an 48

75- (3) A health care provider may not administer intravenous 50

88-vitamin treatment to a patient if the provider determines that 51
89-it is unsafe to administer such treatment based upon the results 52
90-of the self-screening risk assessment qu estionnaire or 53
91-otherwise. 54
92- (4) The respective boards shall adopt rules establishing 55
93-procedures to safely administer intravenous vitamin treatment 56
94-and establish protocols to follow in the event of a health 57
95-emergency, including, but not limited to, requirem ents for: 58
96- (a) Education and training requirements for health care 59
97-providers authorized to administer intravenous vitamin 60
98-treatment. 61
99- (b) Self-screening risk assessments. 62
100- (c) Information that a health care provider must provide 63
101-to a patient before admi nistering intravenous vitamin treatment. 64
102- (d) Documentation regarding the process of administering 65
103-intravenous vitamin treatment. 66
104- (e) Notification that must be provided to a patient's 67
105-designated physician if intravenous vitamin treatment is 68
106-administered. 69
107- (f) Evaluation and review of the administration practices 70
108-used to administer intravenous vitamin treatment. 71
109- (5) Violation of this section constitutes grounds for 72
110-disciplinary action under this chapter and chapter 458, chapter 73
111-459, or chapter 464, as applicable. 74
112- Section 3. This act shall take effect July 1, 2023. 75

89+ (a) Obtain a complete self -screening risk assessment 52
90+questionnaire that has been approved by the board from the 53
91+client before administering intravenous vitamin treatment. If 54
92+the results of the assessment indicate that it is unsafe to 55
93+administer to the client, the procedure may not be performed. 56
94+ (b) Provide the client with the following information: 57
95+ 1. Any potential side effects and risks of intravenous 58
96+vitamin treatment. 59
97+ 2. Instructions on when to seek medical attention. 60
98+ (c) Have a written plan for the appropriate provision of 61
99+emergency care. A copy of the emergency plan must be kept at the 62
100+location offering intravenous vitamin treatment. The plan must 63
101+include the following: 64
102+ 1. The name and address of hospital closest to the 65
103+location at which the intravenous vitamin treatment is being 66
104+performed. 67
105+ 2. Reasons for which an emergency transfer of a client may 68
106+be required. 69
107+ 3. Medical services to be used in the event o f an 70
108+emergency that would place the life or health of a client in 71
109+serious jeopardy. 72
110+ Section 3. This act shall take effect July 1, 2023. 73
