An act relating to use of telehealth; amending s. 2 
456.47, F.S.; authorizing a telehealth provider to 3 
prescribe specified controlled substances for the 4 
treatment of certain health conditions; providing an 5 
effective date. 6

Be It Enacted by the Legislature of the State of Florida: 8 
 9 
 Section 1.  Paragraph (c) of subsection (2) of section 10 
456.47, Florida Statutes, is amended to read: 11 
 456.47  Use of telehealth to provide services. — 12 
 (2)  PRACTICE STANDARDS. — 13 
 (c)  A telehealth provider may not use telehealth to 14 
prescribe a controlled substance listed in Schedule II of s. 15 
893.03 unless the controlled substance is prescribed for the 16 
following: 17 
 1.  The treatment of a psychiatric disorder; 18 
 2.  Inpatient treatment at a hospital licensed under 19 
chapter 395; 20 
 3.  The treatment of a patient receiving hospice services 21 
as defined in s. 400.601; or 22 
 4.  The treatment of a resident of a nursing home facility 23 
as defined in s. 400.021; 24 
 5.  The treatment of a terminal condition as defined in s. 25
