22	22	Be It Enacted by the Legislature of the State of Florida: 9

24	24	Section 1. Paragraph (f) is added to subsection (10) o f 11
25	25	section 253.03, Florida Statutes, to read: 12
26	26	253.03 Board of trustees to administer state lands; lands 13
27	27	enumerated.— 14
28	28	(10) The Board of Trustees of the Internal Improvement 15
29	29	Trust Fund and the state through any of its agencies are hereby 16
30	30	prohibited from levying any charge, by whatever name known, or 17
31	31	attaching any lien, on any and all materials dredged from state 18
32	32	sovereignty tidal lands or submerged bottom lands or on the 19
33	33	lands constituting the spoil areas on which such dredged 20
34	34	materials are placed, except as otherwise provided for in this 21
35	35	subsection, when such materials are dredged by or on behalf of 22
36	36	the United States or the local sponsors of active federal 23
37	37	navigation projects in the pursuance of the improvement, 24
38	38	construction, maintenance, and operation of such projects or by 25

51	51	a public body authorized to operate a public port facility (all 26
52	52	such parties referred to herein shall hereafter be called 27
53	53	"public body") in pursuance of the improvement, construction, 28
54	54	maintenance, and operation of such facility, includi ng any 29
55	55	public transfer and terminal facilities, which actions are 30
56	56	hereby declared to be for a public purpose. The term "local 31
57	57	sponsor" means the local agency designated pursuant to an act of 32
58	58	Congress to assume a portion of the navigation project costs and 33
59	59	duties. Active federal navigation projects are those 34
60	60	congressionally approved projects which are being performed by 35
61	61	the United States Army Corps of Engineers or maintained by the 36
62	62	local sponsors. 37
63	63	(f) The Department of Environmental Protection shall 38
64	64	approve reclamation or restoration activities on sovereignty 39
65	65	submerged lands involving the deposit of fill material below the 40
66	66	ordinary high-water line or mean high -water line if the fill 41
67	67	material is not actual sediment. The reclamation or restoration 42
68	68	activities may use innovative technologies for fill material, 43
69	69	which may include bonded molecules, such as alum or lanthanum -44
70	70	based technologies. 45
71	71	Section 2. This act shall take effect upon becoming a law. 46
