28 | 28 | | Section 1. Section 944.0232, Florida Statutes, is created 15 |

30 | 30 | | 944.0232 Citizens Collaborative Council. — 17 |
---|
31 | 31 | | (1) The Citizens Collaborative Council, an advisory 18 |
---|
32 | 32 | | council as defined in s. 20.03(7), is created adjunct to the 19 |

33 | 33 | | Department of Corrections. Except as otherwise provided in this 20 |
---|
34 | 34 | | section, the council shall operate in a manner consistent with 21 |
---|

36 | 36 | | (2)(a) The council shall be composed of the following 23 |

62 | 62 | | of the department. The council's membership shall include, to 37 |

63 | 63 | | the greatest extent possible, former prisoners, perso ns who are 38 |
---|
64 | 64 | | directly impacted by the correctional system, and criminal 39 |
---|
65 | 65 | | justice or prison reform advocates. 40 |
---|
66 | 66 | | (3) The council's primary duties and responsibilities 41 |
---|
67 | 67 | | include: 42 |
---|
68 | 68 | | (a) Regularly conducting unannounced visits to adult 43 |
---|
69 | 69 | | correctional facilities, inclu ding facilities operated by 44 |
---|
70 | 70 | | private contractors. Council members may enter any correctional 45 |
---|
71 | 71 | | facility in which prisoners are kept and shall be immediately 46 |
---|
72 | 72 | | admitted to such facilities upon a member's request and may 47 |
---|
73 | 73 | | consult and confer with any prisoner. A co uncil member, upon any 48 |
---|
74 | 74 | | finding of concern, shall immediately contact the warden and the 49 |
---|
75 | 75 | | two will work together to resolve the concern. 50 |

93 | 93 | | (c) Conducting telephone interviews with prisoners in a 56 |

94 | 94 | | manner similar to that of legal counsel in a private area using 57 |
---|
95 | 95 | | a telephone that is not recorded. 58 |
---|
96 | 96 | | (d) Making recommendations to the classification teams, 59 |
---|
97 | 97 | | including recommendations regarding close management, 60 |
---|
98 | 98 | | administrative confinement, and disciplinary hearings. 61 |
---|
99 | 99 | | (4) The council may not interfere with the day -to-day 62 |
---|
100 | 100 | | operations of the department or any facilities operated by or on 63 |
---|
101 | 101 | | behalf of the department, but shall serve as a liaison between 64 |
---|
102 | 102 | | administration and staff and prisoners and prisoners' families 65 |
---|
103 | 103 | | and loved ones. 66 |
---|
104 | 104 | | (5) Members of the council shall serve without 67 |
---|
105 | 105 | | compensation but may receive reimbursement for per diem and 68 |
---|
106 | 106 | | travel expenses as provided in s. 112.061. 69 |
---|
107 | 107 | | Section 2. This act shall take effect July 1, 2023. 70 |
