2121 WHEREAS, Nancy Whited suffered from polycystic kidney 8
2222 disease and scleroderma, her declining kidney function required 9
2323 her to have kidney dialysis and eventually a kidney transplant, 10

2525 WHEREAS, unfortunately Nancy was removed from the kidney 12
2626 transplant list due to complications from an error in a 13
2727 prescribed medication that affected her bone marrow, and 14
2828 WHEREAS, despite her reluctance to ask, several individuals 15
2929 stepped forward as live donor candidates for Nancy, leaving two 16
3030 candidates as perfect matches, and 17
3131 WHEREAS, as one donor seemingly became lost in the 18
3232 paperwork process, the other donors moved further in the 19
3333 process; however, it took nine months to get the tests 20
3434 scheduled, and 21
3535 WHEREAS, Nancy Whited went in for the transplant procedure 22
3636 but her cardiac function had decreased so significantly that the 23
3737 procedure caused her to go into heart failure which eventually 24
3838 ended her life, and 25

5151 WHEREAS, while no one can definitively state that an 26

5353 significantly, any reasonable person would say that a healthier 28
5454 organ recipient is more likely to have a better outcome, NOW, 29

5757 Be It Enacted by the Legislature of the State of Florida: 32

5959 Section 1. This act may be cited as "Nancy's Law." 34
6060 Section 2. Subsection (4) is added to section 395.2050, 35
6161 Florida Statutes, to read: 36
6262 395.2050 Routine inquiry for organ and tissue donation; 37
6363 certification for procurement act ivities; death records review. — 38
6464 (4) The department shall adopt rules that establish 39
6565 standards to streamline: 40
6666 (a) Medical testing of living organ donors by eliminating 41
6767 redundant medical testing if prior testing was done within a 42
6868 specific time. 43
6969 (b) The transfer of medical records between physicians of 44
7070 donors and recipients. 45
7171 Section 3. This act shall take effect July 1, 2023. 46
