22	22	Be It Enacted by the Legislature of the State of Florida: 9
23	23	10
24	24	Section 1. Section 1 of section 3 of chapter 2001 -298, 11
25	25	Laws of Florida, as amende d by chapter 2004-425, Laws of 12
26	26	Florida, is amended to read: 13
27	27	Section 1. Minimum charter requirements. —In accordance 14
28	28	with section 189.031(3) 189.404(3), Florida Statutes, the 15
29	29	following subsections shall comprise the minimum required 16
30	30	charter provisions fo r Collier Mosquito Control District: 17
31	31	(a) The District is organized and exists for all purposes 18
32	32	set forth in this act and chapter 388, Florida Statutes, as they 19
33	33	may be amended from time to time. 20
34	34	(b) The powers, functions, and duties of the District 21
35	35	regarding ad valorem taxation, non -ad valorem assessments, bond 22
36	36	issuance, other revenue -raising capabilities, budget preparation 23
37	37	and approval, liens, foreclosure of liens, use of tax deeds and 24
38	38	tax certificates, and contractual agreements shall be as set 25

51	51	forth in chapters 170, 189, 197, 200, and 388, Florida Statutes, 26
52	52	this act, or any other applicable general or special law, as 27
53	53	they may be amended from time to time. 28
54	54	(c) The District was created by the petition process 29
55	55	formerly contained in chapter 390, Florida Statutes, 1949. 30
56	56	(d) The District's charter may be amended only by special 31
57	57	act of the Legislature, unless otherwise provided by chapter 32
58	58	189, Florida Statutes, or chapter 388, Florida Statutes, as 33
59	59	amended from time to time. 34
60	60	(e) In accordance with sectio n 388.101(2), Florida 35
61	61	Statutes, the District is governed by a five -member board. The 36
62	62	membership and organization of the board shall be as set forth 37
63	63	in this act and chapter 388, Florida Statutes, as they may be 38
64	64	amended from time to time. 39
65	65	(f) Board members may be paid a salary in accordance with 40
66	66	this act and chapter 388, Florida Statutes, as they may be 41
67	67	amended from time to time. Notwithstanding section 388.141(1), 42
68	68	Florida Statutes, board members may also receive benefits, such 43
69	69	as medical insurance or accid ental death and dismemberment 44
70	70	insurance, in addition to the maximum salary allowed under 45
71	71	general law. Each additional benefit will be granted by 46
72	72	unanimous resolution of the District with all members present. 47
73	73	(g) The administrative duties of the Board of 48
74	74	Commissioners shall be as set forth in this act and chapter 388, 49
75	75	Florida Statutes, as they may be amended from time to time. 50

88	88	(h) Requirements for financial disclosure, meeting 51
89	89	notices, reporting, public records maintenance, and per diem 52
90	90	expenses for officers and employees shall be as set forth in 53
91	91	chapters 112, 189, 286, and 388, Florida Statutes, as they may 54
92	92	be amended from time to time. 55
93	93	(i) The procedures and requirements governing the issuance 56
94	94	of bonds, notes, and other evidence of indebtedness by the 57
95	95	District shall be as set forth in chapters 189 and 388, Florida 58
96	96	Statutes, and applicable general laws, as they may be amended 59
97	97	from time to time. 60
98	98	(j) The procedures for conducting District elections and 61
99	99	for qualification of electors shall be pursuant to chapters 189 62
100	100	and 388, Florida Statutes, and applicable general laws, as they 63
101	101	may be amended from time to time. 64
102	102	(k) The District may be financed by any method established 65
103	103	in this act, chapter 189, Florida Statutes, or chapter 388, 66
104	104	Florida Statutes, or any applicable general laws, as they may be 67
105	105	amended from time to time. 68
106	106	(l) Pursuant to section 388.221, Florida Statutes, as it 69
107	107	may be amended from time to time, the District's authority to 70
108	108	levy upon all of the personal and real taxable property in the 71
109	109	District a special tax during each year as maintenance tax is 72
110	110	preserved. 73
111	111	(m) The method for collecting non -ad valorem assessments, 74
112	112	fees, service charges, or state matching funds shall be as set 75
