20	20	equipment used in urban agriculture and nonresidential 7
21	21	farm buildings, farm fences, and farm signs, 8
22	22	respectively, to incorporate the amendment made to s. 9
23	23	604.73, F.S., in references thereto; providing an 10
24	24	effective date. 11

26	26	Be It Enacted by the Legislature of the State of Florida: 13

28	28	Section 1. Paragraph (b) of subsection (3) of section 15
29	29	604.73, Florida Statutes, is amended to read: 16
30	30	604.73 Urban agricultur e pilot projects; local regulation 17
31	31	of urban agriculture. — 18
32	32	(3) DEFINITIONS.—As used in this section, the term: 19
33	33	(b) "Urban agriculture" means any new or existing 20
34	34	noncommercial or new commercial agricultural uses on land that 21
35	35	is: 22
36	36	1. Within a dense urban land area, as described in s. 23
37	37	380.0651(3)(a); 24
38	38	2. Not classified as agricultural pursuant to s. 193.461; 25

51	51	3. Not zoned as agricultural as its principal use; and 26
52	52	4. Designated by a municipality for inclusion in an urban 27
53	53	agricultural pilot project that has been approved by the 28
54	54	department. 29

56	56	The term does not include vegetable gardens, as defined in s. 31
57	57	604.71(4), for personal consumption on residential properties. 32
58	58	Section 2. For the purpose of incorporating the amendment 33
59	59	made by this act to section 604 .73, Florida Statutes, in a 34
60	60	reference thereto, subsection (2) of section 604.40, Florida 35
61	61	Statutes, is reenacted to read: 36
62	62	604.40 Farm equipment. — 37
63	63	(2) This section does not apply to farm equipment that is 38
64	64	used in urban agriculture, as defined in s. 604.7 3(3). 39
65	65	Section 3. For the purpose of incorporating the amendment 40
66	66	made by this act to section 604.73, Florida Statutes, in a 41
67	67	reference thereto, paragraph (e) of subsection (2) of section 42
68	68	604.50, Florida Statutes, is reenacted to read: 43
69	69	604.50 Nonresidential farm buildings; farm fences; farm 44
70	70	signs.— 45
71	71	(2) As used in this section, the term: 46
72	72	(e) "Urban agriculture" has the same meaning as in s. 47
73	73	604.73(3). 48
74	74	Section 4. This act shall take effect July 1, 2023. 49
